夫妻忠实协议之法律研究

【摘要】： 夫妻忠实协议是否具有法律效力,在“忠诚协议”赔偿第一案披露后引起了广泛讨论。夫妻忠实协议是否是法律意义上的协议、是否应赋予其法律效力都存在极大的争议。本文认为,夫妻忠实协议的出现有其社会基础及积极意义。夫妻忠实协议所具有的设权意思表示使其成为法律意义上的协议。同时,赋予夫妻忠实协议法律效力并明确判断夫妻忠实协议效力的法律依据是我国婚姻家庭法的必然要求。本文分成前言、正文和结束语三大部分。正文部分分为三章。第一章对夫妻忠实协议进行实证研究,其中包括两个部分。第一部分就公众对夫妻忠实及夫妻忠实协议的认知进行实证调查。通过调查,印证了夫妻忠实的重要性、忠实方为婚姻中的弱者及夫妻忠实协议在调整夫妻间忠实行为中的价值等观点。调查也说明了法律调整夫妻忠实的必要性。第二部分介绍夫妻“忠诚协议”赔偿案件及司法界、理论界对该案件的观点,并对这些观点进行评析。同时,提出判定夫妻忠实协议所需要解决的问题。第二章分析夫妻忠实协议的法律属性。论述了“协议”及相关概念,夫妻忠实应为法律上的权利义务,调整夫妻忠实的协议应为法律意义上的协议及夫妻忠实协议为人身性质协议的观点。第三章从婚姻家庭法法价值的角度论证了立法调整夫妻忠实协议的必要性,并在此基础上讨论了司法裁判夫妻忠实协议的必要性。阐述了夫妻忠实协议的效力应从签订夫妻忠实协议的主体、客体、意思表示的自愿、赔偿数额等方面进行判断,并提出了若干立法建议。
[Abstract]:Whether the husband and wife loyalty agreement has legal effect or not, it has been widely discussed after the disclosure of the first case of the "loyalty agreement" compensation. Whether the marital loyalty agreement is an agreement in the legal meaning and whether the legal effect should be given to it has great controversy. This article holds that the appearance of the couple's faithful agreement has its social basis and positive significance. At the same time, the legal basis of giving the husband and wife the legal effect of the faithful agreement and clearly judging the validity of the husband and wife's faithful agreement are the necessary requirements of the marriage and family law of our country.
This article is divided into three parts: preface, main body and concluding remarks. The main body is divided into three chapters.
The first chapter carries out an empirical study on the husband and wife loyalty agreement, which includes two parts. The first part is an empirical study on the public's cognition of husband and wife loyalty and the loyalty agreement of husband and wife. Through the investigation, the importance of husband and wife loyalty is confirmed, and the value of loyalty is the value of the loyalty agreement between husband and wife in the adjustment of the faithful behavior between husband and wife. The second part introduces the "loyalty agreement" compensation case and the judicial circle, the theoretical circles' views on the case, and comments on these views. At the same time, it puts forward the problems to be solved for the determination of the husband and wife's faithful agreement.
The second chapter analyzes the legal attributes of the husband and wife's loyalty agreement. It discusses the "agreement" and the related concepts. The husband and wife should be the legal rights and obligations. The agreement on the loyalty of the husband and wife should be the agreement on the legal meaning and the agreement of the husband and wife to the personal nature agreement.
The third chapter, from the angle of the value of marriage and family law, demonstrates the necessity of the legislative adjustment of the faithful agreement between husband and wife, and on this basis discusses the necessity of the faithful agreement between the judiciary and the husband and wife. A number of legislative proposals were put forward.
