【摘要】： 赡养协议作为我国特有的赡养模式已经有着悠久的历史。但是,由于我国在目前的社会保障的建设过程中一直关注的是国家的努力和投入,关注的是西方模式社会保障体系的建设,而很少有人关注和探讨如何利用我们传统的家庭赡养模式来构建我们自己的社会保障模式。而就传统家庭赡养模式中的协议赡养而言,人们已经有些淡忘,并在生活中有很多的错误认识。赡养协议是指,在父母丧失劳动能力的情况下,赡养人就履行赡养义务与被赡养人订立的协议,或赡养人相互间为分担赡养义务而签订的一种协议。赡养协议在我们国家之所以能够有如此坚韧的生命力,主要源于我们国家特殊的社会环境,即小农经济的自然经济形态、特殊的家庭结构、儒家“孝”的观念的约束,等等。赡养父母在法律上虽然是每一个子女的强制性义务,但是在实际生活中主要落在个父母一同生活的男性后代身上。在签订赡养协议的时候,父母居于比较重要的地位。赡养协议的内容主要是以何种方式来赡养父母。赡养协议与分家协议、遗赠扶养协议是不同类型的协议。赡养协议的基本形式是“轮流值养”和“分包父母”。其特点和原则各不相同。并在今日社会有不同形态的变异。并且出现了委托赡养这种形式的重要变异。针对我们国家的实际情况,笔者提出了一些立法建议:1)在刑事立法中,修改刑法虐待罪的刑罚,增加服役社会公益劳动处罚方式,制度化张贴悔过书等制度;2)在民事立法中,鼓励当事人设立违约金制度,而违约金首先用来保障老人生活,在其过世之后,归履行义务一方的人所有;针对第三人的某些行为,提出了增设精神损害赔偿制度。另外,在婚姻法等法律中也提出了些立法意见。除此外,笔者认为,在我国目前的最大困难就是法律的贯彻落实。笔者认为我们应该明晰化村委的职权,利用村规民约来贯彻落实赡养协议,来指导人们的行为。在处理该类纠纷时候,我们充分利用社会上各种积极力量,要注重调解。赡养协议制度的建立,无论对我国的立法还是探索社会保障模式都是大有裨益的,值得我们来研究该问题。

The basic forms of alimony agreements are "rotation value raising" and "parenting parents". Their characteristics and principles are different. There are different forms of variation in today's society. And important variations in the form of entrusting support have emerged.
In view of the actual situation of our country, the author puts forward some legislative proposals: 1) in the criminal legislation, it is necessary to modify the punishment of the crime of abuse of criminal law, to increase the punishment of public service in the service of the social service, to institutionalize the system of penitent books and so on; and 2) to encourage the parties to establish a system of breach of contract in the civil legislation, and the liquidated damages are first used to guarantee the life of the elderly, After the death of the party, the person who has returned to the obligation to fulfill the obligation is all. In view of some behavior of the third people, the system of compensation for compensation for mental damage is put forward. In addition, some legislative opinions have been put forward in the law of marriage law. In addition, the author thinks that the biggest difficulty in our country is the implementation of the law. In dealing with the disputes, we make full use of various active forces in the society and pay attention to mediation. The establishment of the support agreement system is of great benefit to both the legislation of our country and the mode of exploring the social security. It is worth studying.
