我国残疾人婚姻家庭权益保障问题研究

【摘要】：家庭是残疾人生活的主要场所,甚至是他们赖以生存的唯一依靠。但他们在婚姻家庭生活中遇到了许多健康人难以想象的困难。残疾人在婚姻家庭生活中遇到的主要问题有:结婚自由权难以实现;婚检、孕检率低;监护规定不到位,养老问题没有得到真正解决;离婚时法律没有规定特殊的保障措施等。而《中华人民共和国残疾人保障法》对残疾人的婚姻家庭权益未作任何保障性的规定。因此,在修订《中华人民共和国残疾人保障法》时,应当增加有关保障残疾人婚姻家庭权益的内容,以切实保障他们的合法权益。
[Abstract]:The family is the main place for the disabled to live, even the only thing they depend on for survival. But they have encountered many unimaginable difficulties in marriage and family life. The main problems encountered by the disabled in marriage and family life are: marriage freedom is difficult to realize; premarital examination, pregnancy examination rate is low; guardianship regulations are not in place, pension problems have not been really resolved; divorce law does not provide special protection measures, etc. However, the Law of the people's Republic of China on the Protection of the disabled does not provide any protection for the rights and interests of the disabled in marriage and family. Therefore, when amending the Law of the people's Republic of China on the Protection of the disabled, it is necessary to increase the contents of protecting the rights and interests of the disabled in marriage and family so as to ensure their legitimate rights and interests.
