我国劳动争议处理制度存在的问题及制度完善

【摘要】:随着我国市场经济结构的调整和劳动用工制度改革的深入,劳动关系的双方当事人之间因劳动权利和义务而发生的纠纷急剧上升,,我国的劳动争议处理制度已经在很多方面不能够适应甚至滞后于市场经济条件下劳动关系的发展需要,出现了诸如劳动争议处理周期长、成本高、不利于保护劳动者的合法利益等弊端。笔者是一名从事民事审判工作的法官,审理过大量的劳动争议诉讼案件,在实际工作中能深切体会到劳动争议处理制度存在的问题,深感这项制度亟待进一步完善。本文试图通过对我国现行劳动争议处理制度的反思及国外市场经济国家劳动争议处理制度的比较,尝试性地就建立一个既符合我国国情,又符合市场经济运行规则且与国际接轨的劳动争议处理制度提出了相应的建议。 全文共分四部分。第一部分对我国现行劳动争议处理制度予以概述,以期对这项制度的历史发展和现行法律规定(现状)有一个客观的了解和认识;第二部分通过对中外劳动争议处理制度在调解、仲裁、诉讼处理方式的规定等方面的比较,以期为进一步完善我国的劳动争议处理制度提供一点有益的借鉴和帮助;第三部分是对劳动争议处理在实践中的现状及暴露的问题(负面作用)进行分析,这些现状和问题应是改革与完善的关键之所在,从争议处理体制、机构、以及立法问题等方面挖掘该项制度诸多弊端的根源,以期对该项制度的改革与完善有所裨益;第四部分从现行劳动争议制度存在的合理性及存在的问题,立足实践,提出改革与完善劳动争议处理制度的构想。
[Abstract]:With the adjustment of market economic structure and the deepening of labor employment system reform, the disputes between the two parties of labor relations due to labor rights and obligations have risen sharply. China's labor dispute handling system has been unable to adapt to or even lag behind the needs of the development of labor relations under the conditions of market economy in many aspects, such as the long period of labor dispute settlement, high cost, The author is a judge engaged in civil trial, who has tried a large number of labor dispute litigation cases, and can deeply understand the problems existing in the labor dispute handling system in practical work. This paper attempts to establish a labor dispute settlement system in accordance with the situation of our country through the introspection of the current labor dispute handling system in our country and the comparison of the labor dispute settlement system in foreign market economy countries. It also puts forward the corresponding suggestions of labor dispute settlement system which accords with the market economy operation rules and is in line with international standards. The paper is divided into four parts. The first part gives an overview of the current labor dispute handling system in China, in order to have an objective understanding and understanding of the historical development of this system and the current legal provisions. The second part through the domestic and foreign labor dispute handling system in the mediation, the arbitration, the lawsuit settlement way stipulation and so on aspect comparison, hoped for further consummates our country labor dispute processing system to provide some beneficial reference and the help; The third part is to analyze the current situation of labor dispute handling in practice and the exposed problems (negative effects), which should be the key to reform and perfection. In order to benefit the reform and perfection of the system, part 4th is based on the rationality and problems of the current labor dispute system. This paper puts forward the idea of reforming and perfecting the labor dispute handling system.
