陈进等农民工劳动争议案法律分析

【摘要】:随着我国经济的高速发展,越来越多的农村富余劳动力转移到城市就业,出现了农民工这一特殊群体。农民工群体日益成为我国劳动力市场的一大生力军,为推进我国的工业化、城镇化、现代化发展发挥了巨大作用。但是由于传统户籍制度的影响,导致农民工在城市受到很多偏见和歧视。绝大多数农民工只能从事城市人不愿干的工作,工作环境极其恶劣,缺乏必要的劳动保护设施。有些用人单位从不与他们签订劳动合同,拖欠工资、超时、节假日加班等侵犯劳动者合法权益的现象屡见不鲜。本案就是其中的缩影。本案原告陈进等人一方面由于我国劳动争议时效存在不完善的地方,国有企业改制的监管不力,“逆向”派遣等原因造成了原告合法权益受到侵害,另一方面由于社会保障体系、劳务派遣等制度的不完善,劳动监察监督执法不严等问题,造成农民工合法权利得不到有效救济。因此本文对这些问题进行了深入的探讨和思考,希望从法律、政府、社会以及个人等方面保障农民工的合法权益提出了个人观点。 本文首先论述了本案出现的上述问题以及笔者的对这些问题的法律分析及思考。第一章首先对陈进等农民工劳动争议案件的基本案情进行了详细介绍,对案件的事实、法院判决以及争议焦点进行了简单梳理,为下文笔者对案件的争议焦点进行分析做好了铺垫。 第二章先后对本案涉及到的劳动争议时效问题,国有企业改制后的法律责任,事实劳动关系和劳务派遣等法律问题进行了详细分析。首先,通过分析《劳动争议仲裁调解法》是否具有溯及力以及劳动争议发生之日的不同理解,来说明在司法实践中对劳动争议仲裁时效应从保护处于弱势地位的劳动者角度出发。然后从法律法规、政策精神及“利益相关者”理论出发分析了国有企业改制后应承担的法律责任,并对国有企业改制中如何保护劳动者劳动权的提出了一些具体措施。之后通过对本案事实、事实劳动关系特点、劳务派遣三方主体之间的性质和“逆向”派遣本质分析得出双方存在事实劳动关系而不是劳务关系的结论。最后从上述分析得出保护事实劳动的重要性和用工单位和劳动者之间适用双重劳动关系说但在具体操作中应保持相对公平的重要原则,从而实现劳务派遣主体三方共赢局面,避免如本案一样以“逆向”派遣方式侵犯劳动者权益的问题再次出现。 第三章揭示出本案所折射出的农民工权益保障缺失的社会问题,并从案件所反映的问题作为出发点对完善劳动仲裁时效制度、劳务派遣制度和社会保障制度,实行行政奖励制度,加强劳动监察部门执法力度等方面提出了一些看法和建议。
[Abstract]:With the rapid development of China's economy, more and more rural surplus labor force has been transferred to urban employment, and a special group of migrant workers has emerged. Migrant workers have increasingly become a major force in China's labor market. In order to promote the industrialization, urbanization and modernization of our country, it has played a great role. However, due to the influence of the traditional household registration system, This has led to a lot of prejudice and discrimination against migrant workers in the city. The vast majority of migrant workers can only do jobs that city people do not want to do, and the working environment is extremely poor. Lack of necessary labor protection facilities. Some employers never sign labor contracts with them. Overtime on holidays and other violations of the legitimate rights and interests of workers are common. This case is a microcosm. Chen Jin, the plaintiff, on the one hand, is imperfect because of the limitation of labor disputes in our country. The poor supervision of the reform of the state-owned enterprises, the "reverse" dispatch and other causes have caused the plaintiff's legitimate rights and interests to be infringed upon. On the other hand, due to the imperfections of the social security system and the labor dispatch system, and the lax enforcement of the labor supervision and supervision laws, and so on, Therefore, this paper makes a deep discussion and reflection on these problems, hoping to protect the legitimate rights and interests of migrant workers from the legal, government, social and personal aspects. This paper first discusses the above problems in this case and the author's legal analysis and reflection on these problems. The first chapter introduces in detail the basic facts of the cases of migrant workers such as Chen Jin, and the facts of the cases. The court judgment and the focus of the dispute were simply combed, which paved the way for the author to analyze the dispute focus of the case. The second chapter has carried on the detailed analysis to the labor dispute prescription question, the state-owned enterprise legal responsibility after the reform, the fact labor relations and the labor dispatch and so on legal question. By analyzing whether the Labor dispute Arbitration Mediation Law has retroactive effect and the different understanding of the date of labor dispute, To illustrate that in judicial practice, the statute of limitations for arbitration of labor disputes should proceed from the point of view of protecting workers in a weak position. Then, from the perspective of laws and regulations, The spirit of the policy and the theory of "stakeholder" analyze the legal responsibility of the state-owned enterprises after restructuring, and put forward some concrete measures to protect the labor rights of the workers in the process of the reform of the state-owned enterprises. Then, through the facts of the case, the author puts forward some concrete measures to protect the labor rights of the workers in the reform of the state-owned enterprises. The characteristics of factual labor relations, The analysis of the nature and the "reverse" nature of the tripartite subjects of labor dispatch draws the conclusion that there is a factual labor relationship rather than a labor relationship between the two parties. Finally, the importance of protecting factual labor and the employment order are drawn from the above analysis. The important principle that the dual labor relationship theory should be applied between the worker and the worker, but the relative fairness should be maintained in the concrete operation, In order to realize the tripartite win-win situation of the main body of labor dispatch and avoid the problem of infringing workers' rights and interests in the way of "reverse" dispatch as in this case. The third chapter reveals the social problems of the lack of protection of the rights and interests of migrant workers reflected in this case, and from the point of view of the problems reflected in the case as a starting point to improve the system of limitation of labor arbitration, labor dispatch system and social security system. This paper puts forward some opinions and suggestions on implementing the administrative reward system and strengthening the law enforcement of labor inspection departments.
