依靠职工群众实行全员劳动合同制的一种好方法

【摘要】：正改革企业劳动人事、工资分配和社会保险三项制度,破除一切束缚和不适应生产力发展、陈旧过时、僵滞的生产关系与管理方式。是当前深化企业改革,转换经营机制的重点。在这三项制度改革中,劳动制度改革处于首要位置,改革的关键是冲破原有固定用工制度,推行全员劳动合同制,重新确立企业与职工之间的劳动关系。改革的理想目标模式是建立国家宏观调控,企业用工自主,多种形式并存,全员劳动合同,职工能进能出,实行“双向选择”的新型用工制度。本文试就如何依靠职工群众搞好全员劳动合同制改革,重点就诸城市创造的厂长与职代会签定劳动合同这一新生事物,从劳动法学的角度,谈点尚不成熟的粗浅认识和想法,不当之处请大家匡正。
[Abstract]:The three systems of labor and personnel, wage distribution and social insurance in enterprises are being reformed, and all production relations and management methods which are out of date and outdated and which are not suitable for the development of productive forces are being broken.It is the focal point that deepens enterprise reform at present, change management mechanism.In these three system reforms, the labor system reform is in the primary position, the key of the reform is to break through the original fixed employment system, to carry out the whole labor contract system, and to re-establish the labor relationship between the enterprise and the workers.The ideal target mode of the reform is to establish a new type of employment system with national macro-control, independent employment of enterprises, coexistence of various forms, full labor contract, the ability of workers to enter and exit, and the implementation of "two-way selection".On how to rely on the masses of workers to do a good job in the reform of the whole labor contract system, this paper focuses on the labor contract signed by the factory director and the staff Congress created in Zhucheng. From the angle of labor law, this paper discusses some elementary understandings and ideas which are not yet mature.Please correct your mistakes.
