《论工伤保险补偿与民事损害赔偿的关系》

【摘要】:随着我国经济的发展以及工业化建设的不断深入,工伤事故已成为当今社会无法回避的问题。而对于工伤事故的救济发展至今,主要形成了三种方式,民事损害赔偿、商业保险、工伤保险。尤其是民事损害赔偿与工伤保险补偿已成为最基本的救济方式,在两者并存时如何处理的问题,关系到用人单位和劳动者双方的切身利益。然而我国法律对如何处理两者之间的关系并未作一般性具体的规定,相关规定之间也存在着一些矛盾。本文首先就工伤保险及民事侵权损害赔偿请求权做了简要的阐述,分析工伤保险责任与民事侵权责任两种不同的责任方式产生的原因,以及两者之间的关系。对各国在工伤保险责任与民事侵权责任并存时所选择的不同的处理机制进行分析,总结利弊。之后,分析我国关于工伤保险补充与民事损害赔偿相关法律规定,探讨其合理性和不足之处。最后,提出我国现阶段应当采用的处理模式。 本文的创新之处在于,主张根据工伤发生的原因,采取不同的处理方式,即涉及雇主侵权导致工伤的场合:在雇主无故意或者重大过失导致工伤时采取替代模式;雇主存在故意或者重大过失时采取补充模式。在涉及第三人侵权导致工伤的场合:“第三人”侵权导致工伤时采取兼得模式;上下班途中,劳动者发生交通事故,第三者负事故全部、主要或同等责任导致的工伤,则采取补充模式。在最大程度上保护劳动者合法权益的基础上,对劳动者和用人单位的利益加以平衡,进而有助于构建和谐的劳动关系。
[Abstract]:With the development of economy and the deepening of industrialization, industrial accidents have become an unavoidable problem in our society.The relief for industrial accidents has been developed to date, mainly formed three ways, civil damage compensation, commercial insurance, industrial injury insurance.In particular, civil damage compensation and compensation for industrial injury insurance have become the most basic relief method. How to deal with the problem when both of them coexist is related to the vital interests of both employers and workers.However, there are no general and specific provisions on how to deal with the relationship between the two, and there are some contradictions between the relevant provisions.In this paper, first of all, the author makes a brief exposition on industrial injury insurance and the claim right of civil tort damages, analyzes the causes of the two different forms of liability for industrial injury insurance and civil tort liability, as well as the relationship between the two.This paper analyzes the different processing mechanisms of industrial injury insurance liability and civil tort liability, and summarizes the advantages and disadvantages.After that, the author analyzes the relevant laws and regulations about the supplement of industrial injury insurance and civil damages, and probes into its rationality and deficiency.Finally, the paper puts forward the treatment mode that our country should adopt at the present stage.The innovation of this paper is that according to the causes of industrial injury, different treatment methods should be adopted, that is, involving the situation where the employer infringes on the work injury: the alternative mode is adopted when the employer does not intentionally or the gross negligence results in the injury;If the employer has intentional or gross negligence, a supplementary model shall be adopted.In cases involving the injury caused by the infringement of a third party: the "third person" tort causes the injury to be done at the same time; the worker has a traffic accident on the way to and from work, and the third party is responsible for all, mainly or equally, the work injury caused by the accident,Then the supplementary mode is adopted.On the basis of protecting the legitimate rights and interests of the laborer to the greatest extent, the interests of the laborer and the employer should be balanced, which will help to construct the harmonious labor relationship.
