【摘要】：本文通过对中国及外国关于外国使领馆使用本地雇员管理体制和相关规定的比较以及对外国驻华使领馆中国雇员劳动权益保护现状的阐述,从中国外交服务管理体制、政府在实践中对外交/领事特权与豁免问题所采取的原则、外国驻华使领馆中国雇员劳动权益保障的法制建设三方面分析外国驻华使领馆中国雇员劳动权益受侵害及劳动权益保护工作存在现实障碍的原因,进而提出“归口管理”政策法制化、完善现行法律法规、设定劳动争议处理程序、统一外交服务机构单位属性、采用限制豁免主义、推行使领馆使用中国雇员的新协议、设立赔偿保险基金等建议。
[Abstract]:Through the comparison between China and foreign countries on the management system and related regulations of using local employees in foreign embassies and consulates, and the current situation of labor rights and interests protection of Chinese employees in foreign embassies and consulates in China, this paper discusses the management system of China's diplomatic service.The principles adopted by governments in practice with regard to the question of diplomatic / consular privileges and immunities,Three aspects of the legal system for the Protection of Labor Rights and interests of Chinese employees in Foreign embassies and Consulates in China the reasons for the infringement of the labor rights and interests of Chinese employees in foreign embassies and consulates in China and the practical obstacles to the protection of labour rights and interests are analyzed.Then it puts forward the legalization of the "centralized management" policy, the improvement of existing laws and regulations, the establishment of labor dispute handling procedures, the unification of the attributes of foreign service agencies, the adoption of the doctrine of restrictive immunity, and the promotion of a new agreement on the use of Chinese employees by embassies and consulates.The establishment of compensation insurance fund and other recommendations.
