我国服刑人员劳动权立法保护研究

【摘要】：劳动权是最基本的人权与公民权，越来越多的国家将其载入宪法。劳动是我国监狱对服刑人员进行改造的主要手段之一，作为“人”和“公民”，服刑人员在监狱中的劳动权不因其受到刑罚而被剥夺。随着现代行刑理念的转变和人权事业的发展，服刑人员的劳动权保护问题越来越得到国际社会的重视，但我国法律对服刑人员劳动权的规定还不够完善，，相关法条过于原则，可操作性差；权利体系不完整，存在大量法律空白；立法内容滞后于社会发展。因此现行立法已无法满足法律实践的需要，必须尽快加以完善。本文首先分析服刑人员劳动权的含义和内容。然后结合服刑人员劳动权的内容，研究立法现状中存在的缺陷。最后提出完善我国服刑人员劳动权立法保护的建议。
[Abstract]:The right to work is the most basic human right and citizenship, and more and more countries have enshrined it in their constitutions.Labor is one of the main means of reforming the prisoners in our country's prisons. As "people" and "citizens", the prisoners' right to work in prison is not deprived of their punishment.With the change of the concept of modern execution and the development of human rights, the protection of the labor rights of prisoners has been paid more and more attention by the international community. However, the provisions of Chinese law on the labor rights of prisoners are not perfect enough, and the relevant laws are too principled.Poor maneuverability; incomplete system of rights, a large number of legal gaps; legislation content lags behind social development.Therefore, the current legislation can not meet the needs of legal practice, must be improved as soon as possible.This paper first analyzes the meaning and content of the labor rights of prisoners.Then combined with the content of the labor rights of prisoners, the defects in the legislative situation are studied.Finally, some suggestions are put forward to improve the legislative protection of the labor rights of prisoners in China.
