劳动关系调节机制国际比较研究

【摘要】:劳动关系是当今社会经济关系中最重要的关系之一,劳动关系问题不单单是经济和社会问题,也有可能转化为政治问题。劳动关系是否稳定直接影响着社会经济中其他各类关系的和谐与稳定。中国目前处于社会主义初级阶段,劳动力市场供给大于需求,劳动者的地位明显低于资本所有者的地位,资强劳弱的状况普遍存在。 据统计,自1995年《中华人民共和国劳动法》颁布实施以来,中国的劳动争议呈现出不断上升的趋势。劳动争议数量增加的原因主要是中国在体制转轨过程中,劳动法律的过于粗线条、劳动争议仲裁的制度缺陷、劳动监察力度的薄弱以及社会保障制度的不完善,使得劳动者利益经常受损,成为体制改革成本的被转嫁者,并进而导致了劳资矛盾的激化和劳动争议数量的急剧攀升。 西方学者从不同的立场和理念出发,对劳动关系进行研究,得出了各不相同的结论,形成了比较有代表性的五大理论学派,按照政治趋向上的保守到激进的顺序排列为:新保守学派、管理主义学派、正统多元论学派、自由改革主义学派和激进学派。本文主要对该五大学派实践典型国家的劳动调节机制进行比较研究,着重分析各国劳动关系主体地位、劳动调节模式、集体谈判制度和劳动争议处理等方面。借鉴发达国家的经验教训,结合我国劳动关系中存在的问题,提出解决现阶段劳动关系问题的有效制度——三方协商机制,并对建立健全三方协商机制提出合理化建议。
[Abstract]:Labor relationship is one of the most important relations in social and economic relations. The problem of labor relations is not only an economic and social problem, but also a political one. Whether the labor relationship is stable or not directly affects the harmony and stability of other kinds of relations in the social economy. At present, China is in the primary stage of socialism, the supply of labor market is larger than demand, and the position of labor is obviously lower than that of capital owner. According to statistics, since the promulgation and implementation of the Labor Law of the people's Republic of China in 1995, labor disputes in China have been on the rise. The main reasons for the increase in the number of labor disputes are that in the process of system transition in China, the labor law is too rough, the system of labor dispute arbitration is defective, the intensity of labor supervision is weak, and the social security system is not perfect. The interests of workers are often damaged and become the transferee of the cost of system reform, which leads to the intensification of labor conflicts and the sharp increase of the number of labor disputes. From different standpoint and concept, western scholars have studied labor relations, drawn different conclusions, and formed five representative schools of theory. According to the order of conservatism to radicalism in the political trend, they are neo-conservative school, managementist school, orthodox pluralistic school, liberal reformist school and radical school. This paper makes a comparative study on the labor regulation mechanism of the five schools of thought in the typical countries, focusing on the analysis of the main position of labor relations, the mode of labor regulation, the system of collective bargaining and the handling of labor disputes in various countries. Using the experience and lessons of developed countries for reference, combined with the existing problems in China's labor relations, this paper puts forward an effective system-tripartite consultation mechanism for solving the problems of labor relations at present, and puts forward some reasonable suggestions for establishing and perfecting the tripartite consultation mechanism.
