【摘要】：社会保险涉及宪法、劳动法、经济法和行政法多个法律部门,对于劳动者的社会保险法律关系而言,又以劳动法律关系为核心。随着我国航运业和市场经济的不断发展,船员与雇主间的劳动关系也随之呈现主体多元化、运行市场化、关系契约化的特点。尤其是船员作为特殊的劳动群体,其劳动条件、就业形式都与一般陆上劳动者存在极大的差异,妥善保障其社会保险权利必须根据其特殊性与现实需求,必须对涉及船员社会保险的相关法律法规进行完善,进行一定程度的倾斜性保护。本文以海上劳动、船员就业模式及其相关因素与陆上劳动者的差异,分析现行船员社会保险法律制度对船员群体的社会保险权利保护存在的问题,并与涉及船员社会保险的外国法及国际公约中对于船员社会保险的相关规定进行比较分析,并结合其立法背景与立法原意,依据船员与船员雇主的现实需求,讨论建立我国船员社会保险制度应当覆盖的船员类型、船员社会保险义务主体、义务内容和法律责任。并提出简化我国船员社会保险纠纷解决机制的基本思路、履行相关行政管理部门对船员社会保险的监督管理义务的具体程序与办法及对船员社会保险制度的改革建议。全文分为绪论、正文和结论。第一章绪论:交代我国船员社会保险实践现状的调查及其存在问题,基于此提出选题背景与研究目的,对本文涉及的基本理论与概念进行界定,介绍国内外研究现状与本文研究方法;第二章:总结我国船员社会保险的立法现状并分析存在的各种问题,着重分析海事立法与劳动立法中对船员社会保险权利保护的不足之处;第三章:在分析外国立法和国际公约中涉及船员劳动权利保护的相关规定的基础上,基于船员海上劳动和就业形式的特殊性,列举部分船员社会保险应当覆盖的特殊船员类型;第四章:通过对当下不同的船员就业形式中各个主体间的法律关系分析,对船员社会保险的义务主体进行识别;并结合相关立法,分析船员用人(工)单位的社会保险义务内容及其法律责任规制;第五章:通过与相关外国立法和国际公约的比较研究,从保障船员范围、义务主体、法律责任、保障机制与促进船员与船员雇主参加社会保险的相关配套措施等方面提出对相关法律法规的立法、修法建议与制度改革建议。
[Abstract]:Social insurance involves many legal departments, such as constitution, labor law, economic law and administrative law. With the continuous development of shipping industry and market economy in China, the labor relationship between crew and employer is characterized by diversification of subject, marketization of operation and contract of relationship. Especially, as a special working group, the working conditions and forms of employment of seafarers are greatly different from those of ordinary land-based workers, so the proper protection of their social insurance rights must be based on their particularity and practical needs. It is necessary to perfect the relevant laws and regulations concerning the social insurance of crew members and to protect them to a certain extent. Based on the differences between marine labor, crew employment mode and related factors, this paper analyzes the problems existing in the current legal system of crew social insurance for the protection of crew members' social insurance rights. It also makes a comparative analysis with the relevant provisions of foreign laws and international conventions concerning the social insurance of crew members, and combines with its legislative background and legislative intent, according to the actual needs of crew members and their employers. This paper discusses the types of crew members who should be covered by the establishment of social insurance system for crew members, the subject of crew social insurance obligations, the content of obligations and legal liability. It also puts forward the basic ideas of simplifying the dispute resolution mechanism of crew social insurance in China, the specific procedures and methods of fulfilling the supervision and management obligation of the relevant administrative departments to the crew social insurance, and the reform suggestions on the crew social insurance system. The full text is divided into introduction, text and conclusion. The first chapter introduces the investigation and existing problems of the practice of crew social insurance in China. Based on this, the author proposes the background and purpose of the research, and defines the basic theories and concepts involved in this paper. Chapter two: summarize the legislation status of China's crew social insurance and analyze the existing problems. Chapter three: on the basis of analyzing the relevant provisions of foreign legislation and international conventions concerning the protection of seafarers' labor rights, Based on the particularity of seafarers' work and employment at sea, this paper lists the special types of crew members that should be covered by social insurance of crew members. Chapter four: through the analysis of the legal relationship among different subjects in different forms of crew employment, To identify the subject of the obligation of crew social insurance, and to analyze the content of the social insurance obligation and the regulation of the legal liability of the crew employing (working) unit in combination with the relevant legislation. Chapter V: through the comparative study with the relevant foreign legislation and international conventions, from the protection of the scope of crew, subject of obligation, legal liability, The legislation, amendment and system reform of the relevant laws and regulations are put forward in the aspects of the safeguard mechanism and the related supporting measures to promote the crew and crew employers to participate in social insurance.
