论我国劳动保障监察制度的完善

【摘要】:劳动保障监察制度作为劳动法基础理论研究以及劳动保障监察部门执法实践中的主要内容,是新时代各个国家依照法律授权对劳动关系进行法律规制与调整的重要方式。在我国实行社会主义市场经济的情况下,市场主体之间的竞争越来越激烈。市场主体为了自身经济效益的最大化,往往通过牺牲劳动者利益为手段以提高企业市场竞争力,这必将违反法律、行政法规的要求。鉴于劳动者处在劳动关系中相对弱势的地位,国家劳动保障监察机关必须以劳动关系的管理者、监督者的身份出现,运用国家法律法规授予的公权力对用人单位损害劳动者合法权益的行为进行行政干预和行政处罚,以维护劳动者的合法权益,促进劳动关系的和谐发展。这也彰显了劳动保障监察制度的价值追求。 但是,由于我国劳动保障监察制度还不完善,在劳动保障监察法律法规、劳动保障监察执法以及监察队伍的建设方面都存在着问题,因此必须重新考究我国劳动保障监察制度以跟上市场经济中不断发展的维权要求。 本文第一个章节主要叙述了劳动保障监察制度的基本理论,涵盖有劳动保障监察制度的历史发展、涵义、法律特性、基本功能以及与劳动仲裁的关系等方面的内容。第二部分主要写目前我国劳动保障监察制度存在的问题、造成的危害及其原因进行了分析。第三部分主要是介绍国外劳动保障监察体制,并以此与我国劳动保障监察的体制进行对比分析,从而得出国外劳动保障监察体制对我国的启示。第四部分主要是在前三部分的基础上,阐述完善劳动保障监察制度具体建议,包括体制、立法、监督、责任四部分内容,主要为针对我国劳动保障监督制度存在的问题提出完善我国劳动保障监察制度的建议。
[Abstract]:Labor security supervision system, as the main content of labor law basic theory research and labor security supervision department law enforcement practice, is an important way for every country to regulate and adjust the labor relations according to the law authorization in the new era. Under the condition of socialist market economy, the competition between market subjects is becoming more and more fierce. In order to maximize their own economic benefits, market subjects often sacrifice the interests of workers as a means to improve the competitiveness of enterprises in the market, which will certainly violate the requirements of laws and administrative regulations. In view of the relatively weak position of the laborer in the labor relations, the state labor security supervision organ must appear as the manager and supervisor of the labor relations. In order to safeguard the legitimate rights and interests of laborers and promote the harmonious development of labor relations, administrative intervention and administrative punishment are carried out on the acts of harming the legitimate rights and interests of workers by the public power granted by the laws and regulations of the state. This also highlights the value pursuit of labor security supervision system. However, because the labor security supervision system in our country is not perfect, there are problems in the aspects of labor security supervision laws and regulations, labor security supervision and law enforcement, as well as the construction of supervisory teams. Therefore, we must re-examine the labor security supervision system in order to keep up with the growing demands of safeguarding rights in the market economy. The first chapter of this paper mainly describes the basic theory of labor security supervision system, including the historical development, meaning, legal characteristics, basic functions and the relationship between labor security supervision system and labor arbitration. The second part mainly describes the existing problems, hazards and causes of labor security supervision system in China. The third part mainly introduces the foreign labor security supervision system, and makes a comparative analysis with our country's labor security supervision system, so as to draw the enlightenment of the foreign labor security supervision system to our country. The fourth part is mainly on the basis of the first three parts, elaborated on the specific proposals to improve the labor security supervision system, including the system, legislation, supervision, responsibility four parts of the content, In order to improve the supervision system of labor security in China, suggestions are put forward to solve the problems existing in the supervision system of labor security.
