职场性骚扰的侵权责任研究

【摘要】:职场性骚扰在我国已经非常普遍,影响了多数的职场工作者的正常生活,《妇女权益保障法》《妇女保护特别规定》及《劳动法》中的原则性规定显然已经不能满足被侵权人的救济诉求。从侵权责任法的角度,职场性骚扰已经侵害了劳动者的工作环境权与性自主权等基本权利,为了保护职场工作者的合法权利,本文研究职场性骚扰的侵权责任,分析讨论职场性骚扰的侵权客体,归责原则与责任方式,为职场工作者提供切实可寻的法律依据。 本文运用文献研究法,比较研究法,功能分析法等方法从侵权责任的构成要件着手研究职场性骚扰的侵权责任认定、归责原则和损害赔偿。本文第一部分主要是概述职场性骚扰的基本概念,因为在我国法律文件中没有明确的性骚扰概念界定,所以笔者运用比较分析的方法列举国内外不同区域的法律界定,得出自己的观点。第二部分主要依据侵权责任构成要件的四个部分研究分析职场性骚扰侵权责任的构成及与其他侵权行为的本质区别。第三部分是对职场性骚扰侵权责任规制的侵权法完善,因为我国多数的文件都是原则性概括职场性骚扰,,并没有明确被侵权人在遭受性骚扰后应该投诉的部门和进入诉讼程序后相应的诉讼程序的完善。笔者建议完善惩罚赔偿金制度和举证责任制度,并且结合预防制度,提高法律对职场工作者的保护的实际操作能力。
[Abstract]:Sexual harassment in the workplace has become very common in our country. It has affected the normal life of the majority of workers in the workplace. The principle provisions in the Women's Rights and interests Protection Law and the Labor Law have obviously failed to satisfy the relief demands of the infringers. From the perspective of tort liability law, workplace sexual harassment has violated workers' basic rights such as the right to work environment and sexual autonomy. In order to protect the legitimate rights of workplace workers, this paper studies the tort liability of workplace sexual harassment. This paper analyzes and discusses the object of tort, the principle of imputation and the way of liability of sexual harassment in the workplace, and provides a practical legal basis for the workers in the workplace. The methods of functional analysis are used to study the tort liability determination, liability imputation and damage compensation of workplace sexual harassment from the constitutive elements of tort liability. The first part of this paper mainly summarizes the basic concept of sexual harassment in the workplace, because there is no clear definition of sexual harassment in the legal documents of our country, the author uses the method of comparative analysis to enumerate the legal definitions of different regions at home and abroad. Come up with your own point of view. The second part is mainly based on the four parts of the constitutive elements of tort liability to analyze the constitution of tort liability of workplace sexual harassment and the essential difference between it and other tort acts. The third part is the improvement of tort law on the regulation of tort liability for workplace sexual harassment, because most of the documents in our country summarize workplace sexual harassment in principle. It is not clear that the department where the infringer should complain after being sexually harassed and the perfection of the corresponding procedure after entering the legal procedure. The author suggests to perfect the system of punishment compensation and burden of proof, and to improve the practical operation ability of legal protection for workers in the workplace in combination with the system of prevention.
