回归与变革:我国失业保险法律制度的完善之路

【摘要】：我国现行失业保险制度和政策运行实践表明其具有社会救助和社会福利属性,这不符合社会保险的制度原理。我国失业保险制度的改革应当使其回归社会保险的制度原理,变革为就业保险,重溯制度目标,实现制度更迭:构建保生活、促就业、防失业三位一体的制度目标模式,其中生活保障是基础,促进就业是核心,预防失业是补充;完成从失业保险向就业保险的制度转化,建立实现制度目标的三项就业保险给付;完善促进就业导向的失业给付制度,将职业介绍补贴和职业培训补贴制度改造为就业给付制度,建立经济不景气时期的缩短工时工资补贴制度。
[Abstract]:The practice of the current unemployment insurance system and policy in China shows that it has the attributes of social assistance and social welfare, which does not accord with the system principle of social insurance. The reform of the unemployment insurance system in our country should make it return to the system principle of social insurance, change into employment insurance, retrace the system target, realize the system change: construct the system target mode of protecting life, promoting employment and preventing unemployment. Among them, life security is the foundation, promoting employment is the core, preventing unemployment is the supplement, completing the system transformation from unemployment insurance to employment insurance, establishing three employment insurance benefits to realize the system goal; To improve the employment-oriented unemployment benefit system, to transform the job introduction subsidy and vocational training subsidy system into the employment compensation system, and to establish the shortened man-hour wage subsidy system during the economic depression.
