劳务派遣退工机制的缺陷与完善

【摘要】:劳务派遣退工机制是劳务派遣的逆向运行系统,包括用工单位退回被派遣劳动者的退回机制,劳务派遣单位解除与被退回劳动者劳动合同的解除机制。由于我国劳动法对劳动者的倾斜保护原则,以及劳务派遣与标准劳动关系相比存在的特殊之处,劳务派遣中用工单位和被派遣劳动者之间不存在劳动关系,同时必须强调二者之间的紧密联系,防止二者间出现断层。目前,我国劳务派遣退工机制中存在三类缺陷:一是在退工机制的适用条件中出现了退工情形的适用范围不明确,适用标准模糊,程序规范不健全三个缺陷;二是在责任制度中出现了对违法退回的认定标准问题,“继续履行”遭遇现实困境,以及缺乏恢复用工的争议处理机制三个问题;三是在监管层面,劳动保障监察出现监管疲软,专业能力不足,取证能力欠缺等问题。为了完善以上缺陷,必须对症下药,针对第一类缺陷,立法须严守退工的适用情形,防止进一步扩大,明确退工情形的适用标准,健全用工单位退回劳动者的程序性规范;针对第二类问题,需要把程序性事项作为衡量是否属于合法退回的标准之一,同时在特定情形下,“继续履行”必须落实到恢复用工关系的层面,并把该争议纳入到劳动争议的范畴;针对第三类问题,需要加强监管力度,提高执法队伍的专业水平和取证能力。由此,通过前述三类措施来弥补当下劳务派遣退工机制中的缺陷。
[Abstract]:The mechanism of labor dispatch is the reverse operation system of labor dispatch, including the return mechanism of labor unit returning dispatched workers, the mechanism of labor dispatch unit rescinding labor contract with returned laborer. Because of the preferential protection principle of labor law in our country and the special place between labor dispatch and standard labor relation, there is no labor relation between employing unit and dispatched laborer in labor dispatch. At the same time, we must emphasize the close connection between the two to prevent the fault between them. At present, there are three kinds of defects in the mechanism of labor dispatch in our country: first, there are three defects in the applicable conditions of the mechanism: the scope of application is not clear, the applicable standard is vague, and the procedure is not perfect; Second, there are three problems in the liability system: the identification standard of illegal return, the realistic dilemma of "continuing performance" and the lack of dispute settlement mechanism for resuming employment; third, at the level of supervision, Supervision of labor security is weak, professional ability is insufficient, evidence collection ability is deficient and so on. In order to perfect the above defects, we must give the remedy to the case. In view of the first kind of defects, legislation should strictly observe the applicable situation of quitting work, prevent further expansion, clarify the applicable standard of the situation of returning workers, and perfect the procedural norms of returning workers of employment units. In response to the second category of issues, procedural matters need to be used as one of the criteria for determining whether or not they fall within the scope of lawful return, while, in specific cases, "continuing performance" must be implemented to the level of the restoration of employment relations, In view of the third kind of problems, we need to strengthen the supervision, improve the professional level of the law enforcement team and the ability of collecting evidence. Therefore, through the above three measures to make up for the current labor dispatch in the mechanism of labor withdrawal defects.
