我国企业用工自主权的立法不足与解决途径
[Abstract]:After the conclusion of the third Plenary session of the 18th CPC Central Committee, the state has intensified its efforts to promote reform and to strengthen support for private enterprises and small and micro enterprises in policy and other directions. Because the present labor law system only makes the principle stipulation to the enterprise employment autonomy, but does not have the concrete operation instruction. Therefore, when the enterprise exercises the right of employment autonomy, it often conflicts with the laborer. After entering the stage of labor arbitration, because of the lack of refinement and clear legal provisions on the autonomy of employment, both the enterprise and the laborer are uncertain about the final result of the ruling. Legislation can not meet the needs of practice, make the enterprise into a dilemma for the employment management, can not make the enterprise fully understand what circumstances can be exercised to adjust the right to pay, the right to punish employees, Employee's right to claim for economic loss caused by fault. This also makes the enterprise unable to achieve the highest efficiency in human resource allocation and personnel management, and optimize resource allocation. If the enterprise cannot carry light load, then the restriction to the enterprise is obviously enormous. In order to solve the confusion of the enterprises in the aspect of employment autonomy and to promote the establishment and improvement of the laws and regulations on the employment of enterprises, it is necessary to conduct a detailed study on the autonomy of employment. Based on the analysis of the difficulties faced by Chinese enterprises and the lack of labor legislation, this paper puts forward a tentative plan for the construction of the system of employment autonomy, in order to promote the perfection and perfection of China's labor law system.
