论大学生的实习权

【摘要】：本文首次提出大学生实习权的概念并对其属性进行系统分析。实习权既是一项受教育权也是一项劳动就业权,它有教育经济学、教育法学、劳动法学等多重特征,对大学生具有生存与发展的价值功能;实习权包括教育实践权、自由实习选择权、劳动报酬权、安全权、休息权、人格权、停止实习权等权利内容;确立实习权的属性特征对政府、学校、企业、司法机关具有现实意义;大学生实习权的侵权主体有政府、高校、用人单位,其侵权客体表现形式具有多样性与复杂性的特征;实习权的落实与保障必须依赖法律路径、财税路径、人力资源路径和管理路径四个路径来实现。
[Abstract]:This paper first puts forward the concept of college students' internship right and systematically analyzes its attributes. The right to practice is not only a right to education but also a right to work and employment. It has many characteristics such as educational economics, education law, labor law and so on, which has the value function of survival and development for college students. The right of practice includes the right of educational practice, the right of free practice, the right of labor reward, the right of safety, the right of rest, the right of personality, the right of stopping practice and so on. It is of practical significance for the government, schools, enterprises and judicial organs to establish the attribute characteristics of the practice right, and the infringement subjects of the college students' internship right are the government, the university, the employing unit, the expression form of the object of infringement has the characteristics of diversity and complexity. The implementation and protection of practice right must depend on four paths: legal path, fiscal path, human resource path and management path.
