对劳动行政处罚自由裁量基准的思考

【摘要】:对行政自由裁量权控制,其核心要求取消不必要的自由裁量,对必要的自由裁量权进行规制。劳动行政处罚自由裁量基准是对劳动行政处罚自由裁量权的行使范围、方式等方面的法律规范加以具体化,是沟通劳动法律规范与具体事实之间的必要媒介,也是劳动行政机关理想行使劳动行政处罚自由裁量权的规制手段。本文通过对劳动法领域的行政处罚自由裁量基准的相关问题进行分析,试图找到对其进行有效规制的途径。文中对劳动行政处罚自由裁量基准概念进行了厘清,认为劳动行政处罚自由裁量的构成分析应从要件和效果两方面来完成。其中,要件构成包括对事实本身的认定、对行为主体的认定以及对不确定法律概念的解释;效果构成包括对是否处罚的裁量、对如何处罚的裁量以及对时效和程序的裁量。通过对劳动行政处罚自由裁量权基准的制定背景以及客观存在的现实状况分析,探究当下制定劳动行政处罚自由裁量基准的必要性。通过对劳动行政处罚自由裁量基准制定中的法律要件分格技术、量罚幅度裁量技术的比较分析,结合实践中各地劳动行政执法部门的做法,提出了制定劳动行政处罚自由裁量基准的方法,明确了在裁量基准制定过程中需要解决的制定主体、法律效力等相关问题。文章还对劳动行政处罚自由裁量基准的立法规制、司法监督和行政控制等方面进行了分析,提出了完善的建议。 研究劳动行政处罚自由裁量基准的相关问题不是要消灭自由裁量,而是要通过制度、技术的引入,抑制权力的恣意行使,促进裁量基准的理性化。制定劳动保障行政处罚自由裁量基准能克服劳动行政处罚自由裁量的随意性,抑制行政权力的寻租和腐败,增强劳动行政处罚决定的正当性,体现形式正义和劳动行政处罚自由裁量的一致性。
[Abstract]:To control the administrative discretion, its core requirement is to cancel the unnecessary discretion and regulate the necessary discretion. The discretionary standard of labor administrative punishment is the embodiment of the scope and mode of the exercise of the discretion of labor administrative punishment, and is the necessary medium between the legal norms of labor law and the concrete facts. It is also an ideal regulatory means for labor administrative organs to exercise the discretion of labor administrative punishment. This paper tries to find an effective way to regulate administrative penalty by analyzing the relevant issues of administrative penalty discretion benchmark in the field of labor law. This paper clarifies the concept of discretion benchmark of labor administrative punishment, and points out that the constitution analysis of labor administrative penalty discretion should be completed from two aspects: elements and effects. Among them, the composition of the elements includes the recognition of the fact itself, the cognizance of the subject of the act and the interpretation of the concept of uncertain law; the component of the effect includes the discretion of whether to punish, the discretion of how to punish and the discretion of the limitation and procedure. Based on the analysis of the background of the establishment of the basis of the discretion of labor administrative punishment and the reality of the objective situation, this paper explores the necessity of establishing the standard of the discretion of the labor administrative punishment at present. Based on the comparative analysis of the legal elements and the discretion techniques in the formulation of the labor administrative penalty discretion standard, and the practice of the labor administrative law enforcement departments in practice, This paper puts forward the method of establishing the discretionary standard of labor administrative punishment, and clarifies the relevant problems such as the subject of establishment, the legal effect and so on, which need to be solved in the process of making the standard of labor administrative punishment. The article also analyzes the legislative regulation, judicial supervision and administrative control of the discretionary standard of labor administrative punishment, and puts forward some perfect suggestions. The research on the discretionary standard of labor administrative punishment is not to eliminate the discretion, but to restrain the arbitrary exercise of power through the introduction of system and technology, and to promote the rationalization of the discretion standard. The establishment of the labor security administrative penalty discretion standard can overcome the arbitrariness of the labor administrative penalty discretion, restrain the rent-seeking and corruption of the administrative power, and enhance the legitimacy of the labor administrative penalty decision. Embodies the form justice and the labor administrative punishment discretion consistency.
