非法用工单位伤亡人员一次性赔偿制度之归宿思考

【摘要】：非法用工单位的提法由工商行政管理法规相关规定衍变而来,被移植于劳动法中作为区别于用人单位的一个专有概念使用,并以此构建非法用工单位伤亡人员一次性赔偿制度。该制度以对"用人单位"范围的界定来判断务工人员是否具备"劳动者"身份,从而在实质上剥夺了非法用工单位职工获得工伤保险保障的权利。相对于工伤赔偿,非法用工单位一次性赔偿制度在法律及理论依据、法律实施社会效果等方面存在诸多不足。因此,对非法用工单位职工发生事故伤害处理的最佳方式,应是废除一次性赔偿制度,统一实行工伤赔偿。
[Abstract]:The formulation of illegal employment units evolved from the relevant provisions of industrial and commercial administrative laws and regulations, and was transplanted to the labor law as a special concept different from the employing units, and thus constructed the system of one-time compensation for casualties in illegal employment units. By defining the scope of the "employing unit", the system judges whether the migrant worker has the status of "laborer", thus depriving the workers of the illegal employment unit of the right to obtain the protection of industrial injury insurance. Compared with the compensation for industrial injury, there are many deficiencies in the system of one-off compensation for illegal employment units in the legal and theoretical basis, the social effect of the implementation of the law, and so on. Therefore, the best way to deal with the injury caused by accident in the illegal employment unit should be to abolish the system of one-time compensation and to implement the compensation for industrial injury in a unified way.
