略论当事人不服仲裁委不受理决定之救济

【摘要】：正我国《劳动法》规定用人单位与劳动者发生劳动争议时,当事人请求“公断”只能“先裁后讼”,即先通过仲裁解决纠纷,当事人一方或双方不服仲裁裁决的,再向人民法院提起诉讼。这就是说,人民法院不能受理未经仲裁裁决的劳动争议案件。笔者在司法实践中,曾先后接待过数位手持劳动争议仲裁委员会(以下简称仲裁委)《不予受理决定书》来访的当事人,他们表示不服决定,请求人民法院给予司法救济,但法院苦于受理无据,只能将其拒之门外。根据法律规定,当事人不服人民法院作出的不予受理裁定,尚且有上诉权,而仲裁委一纸决定怎能成为终局决定呢?对此,理论界争论颇多,实践中认识不一。笔者就此谈点粗浅看法。
[Abstract]:In the case of labor dispute between the employing unit and the worker under the Labor Law of our country, the parties request the "public break" to make the "pre-cutting" only, namely, the dispute shall be settled through the arbitration, the party or the two parties are not satisfied with the arbitration award, and the people's court shall be brought to the court for action. That is to say, the people's court shall not accept the labor dispute case of the non-arbitration award. In that judicial practice, the author has received the decision of the digital hand-held labor dispute arbitration committee (hereinafter referred to as the arbitration committee) to not accept the decision to accept the decision. It can only be turned out of the door. According to the law, the party refuses to accept the decision of the people's court and has the right to appeal, and how can the arbitration commission decide how to be the final decision? In this regard, there are many arguments in the field of theory, and the practice is different. The author has a rough point of view on this.
