我国劳动合同期限问题研究

【摘要】: 劳动合同制度是我国现行的劳动用工制度,它在我国的劳动法律关系中发挥了重要的作用。劳动合同期限是缔结劳动合同所必须约定的首要问题。本文立足于本国劳动法的视角,通过借鉴比较的方法对劳动合同期限的理论及实践进行了全面的研究。通过对劳动合同基本理论的介绍,现行法律存在的冲突分析,结合《劳动合同法(草案)》,来揭示我国现行劳动合同期限法律规定存在的问题。针对这些问题,建议从三方面来重构我国的劳动合同期限制度即建立与劳动合同期限制度相匹配的劳动合同形式规则,扩展无固定期限劳动合同的适用和强化固定期限劳动合同的限制。从而能够更好地保护劳动者与用人单位双方的权益,对我国的劳动立法也将起到积极的作用。
[Abstract]:The labor contract system is the current labor employment system in our country, and it plays an important role in the labor legal relations of our country. The term of labor contract is the primary problem that must be agreed upon in order to conclude labor contract. Based on the perspective of domestic labor law, this paper makes a comprehensive study on the theory and practice of the term of labor contract by drawing lessons from the comparative method. Through the introduction of the basic theory of labor contract, the analysis of the conflicts existing in the existing laws, and the combination of the Labor contract Law (draft), this paper reveals the problems existing in the legal provisions on the duration of the current labor contract in China. In view of these problems, it is suggested to reconstruct the labor contract term system in China from three aspects, that is, to establish the formal rules of labor contract matching with the labor contract term system. Extend the application of non-fixed term labor contract and strengthen the restriction of fixed term labor contract. Thus it can better protect the rights and interests of both labourers and employers, and it will also play a positive role in the labor legislation of our country.
