论劳动者心理健康的法律保护

【摘要】：市场经济的高速发展致使了劳动者竞争压力的增大,引发了一系列职业健康问题。其中相较于职业身体健康问题,劳动者职业心理健康问题因其隐蔽性特点,更容易被忽视,从而造成了劳动者心理乃至生理的损害。构建和完善劳动者心理健康法律保护制度,切实维护劳动者的权益刻不容缓。本文从劳动者心理健康法律保护相关理论入手,明确劳动者心理健康的相关概念。对劳动者心理健康法律保护的理论依据与必要性进行分析。阐述我国劳动者心理健康法律保护的现状以及存在的问题,通过对国外劳动者心理健康法律保护制度的介绍及借鉴,提出完善我国劳动者心理健康法律保护的对策。
[Abstract]:The rapid development of market economy leads to the increase of labor competition pressure and causes a series of occupational health problems. Compared with the occupational physical health problem, the occupational mental health problem of labourers is more easily ignored because of its hidden characteristics, thus causing psychological and physiological damage to labourers. It is urgent to construct and perfect the legal protection system of workers' mental health and protect their rights and interests. This article from the laborer mental health legal protection related theory, clarifies the laborer mental health related concept. This paper analyzes the theoretical basis and necessity of the legal protection of the mental health of labourers. This paper expounds the current situation and existing problems of the legal protection of the mental health of our labourers, and puts forward the countermeasures to perfect the legal protection of the mental health of the labourers in our country through the introduction and reference of the legal protection system of the mental health of the workers abroad.
