法律英语和立法文本的功能英译

法律翻译是两种不同语言之间的转换，因此了解法律语言的特点对法律翻译工作十分重要。就法律英语而言，国内外无论是法律界还是语言学界的学者均对其进行了卓有成效的研究和探索，如陈忠诚，Henry Weihofen，Anna Trosborg等。法律翻译可在不同法系间、不同文化和语言间转化，涉及范围广、类型多样。本文拟从法律英语的语言特征出发，剖析其在词汇，句法及文体三个层面上的特点，立足于探讨汉语立法文本的英译，以期以小见大，就法律翻译问题提出一些建议。 论文首先分析了英语立法语言的词汇、句法和文体特征。在词汇方面，该语言大量使用古体词和具有法语和拉丁语渊源的词，多用术语而少用代词，频繁并列使用双名词以及多名词等表现形式；在句法方面，该语言为了强调并保证法律的严明以及公正性，立法条文组织都必须遵从一定的逻辑顺序，多用长句、复杂句、被动句和大量的复杂介词结构及名词化形式。在文体方面，法律英语以精确性、正式性、客观性和一致性为其主要特征。这些语言特征使立法文本具有鲜明的个性，这些个性是选择翻译方法和评判译文标准时不可忽视的基本要素。 在重视法律翻译基本原则——准确、一致和简洁——的...
