【摘要】:预告登记制度是为了防止房地产市场上"一房二卖"现象而出台的一项法律规定,在2007年颁布的《物权法》中首次出现。抵押预告登记是预告登记制度的一项重要内容。在商品房预售的情况下,买受人要向银行申请住房贷款,银行基于其信贷风险的考虑,往往要求买受人将其所预购的商品房作为抵押,担保住房贷款的履行,还要求房地产开发商对买受人所借款项承担阶段性的保证责任。但由于以预售商品房抵押贷款的,如要办理抵押权登记需要提供抵押物产权证书,但由于预售的商品房还在建设的过程中,没有相应的产权证书,故其无法办理抵押权的设立登记,只能选择办理抵押权的预告登记。在预购商品房抵押预告登记办理后,抵押权登记办理前,如买受人违约,银行是否可以就所抵押的预售商品房优先受偿。由于在理论和实务界对抵押预告登记的法律性质和法律效力认识未统一,故各地法院的判决结果也多种多样。本文第一部分介绍了目前预告登记制度的法律规定及司法实务界由于对抵押预告登记法律性质和法律效力认识不同而导致"同案不同判"的现象。本文第二部分对司法实务中各地法院对预购商品房抵押预告登记纠纷案件的裁判进行了梳理,分别介绍了目前各地法院关于银行办理了预购商品房抵押预告登记后对抵押物是否有优先受偿权的具有代表性的四种情形。本文第三部分,先对抵押预告登记的法律性质、法律效力及抵押预告登记的相关制度进行了阐述,结尾对实务中法官的不同裁判观点进行了分析。本文第四部分,前半部分阐述了统一司法标准,正确适用法律的必要性,后半部分提出了预购商品房抵押预告登记纠纷类案件的一些裁判思路,即根据抵押预告登记未推进到本登记的原因在裁判过程中作出不同的处理,采用迂回的方式使银行根据抵押合同的约定完成抵押权登记,从而实现抵押权。本文第五部分乃是结语,简单总结了这篇文章的所有论点。
[Abstract]:Advance notice registration system is to prevent the real estate market "one house two sell" phenomenon and issued a legal regulation. In 2007 promulgated in the "property Law" for the first time. Mortgage registration is an important part of the notice registration system. In the case of commercial housing pre-sale, the buyer should apply to the bank for housing loans. Based on the consideration of its credit risk, the bank often requires the buyer to take the pre-purchased commercial house as collateral to guarantee the performance of the housing loan. Also require real estate developers to the buyer of loans to bear the stage of the guarantee liability. Whether the bank can be mortgaged on the pre-sale of commercial housing priority compensation. Because in theory and practice of the legal nature and legal effect of mortgage registration is not unified. The first part of this paper introduces the legal provisions of the current notice registration system and the different understanding of the legal nature and the legal effect of the mortgage notice registration in the judicial practice circles. In the second part of this article, the author sorts out the judgment of the cases of pre-purchase commercial housing mortgage registration dispute in various courts in judicial practice. This paper introduces four representative cases of whether there is a preferential right of repayment of the mortgage after the banks have dealt with the advance registration of the commercial housing mortgage. The third part of this article. First of all, the legal nature of mortgage notice registration, the legal effect and the relevant system of mortgage notice registration are expounded. At the end of this paper, the author analyzes the judges' different judgment views in practice. Part 4th of this article. The first part expounds the necessity of the unification of judicial standards and the correct application of the law, and the latter part puts forward some judgment ideas for cases of pre-purchase commercial housing mortgage registration disputes. That is, according to the reason that the mortgage notice registration did not advance to this registration, different treatment was made in the judging process, and the bank completed the mortgage registration according to the agreement of mortgage contract. So as to realize mortgage. Part 5th is the conclusion, which summarizes all the arguments of this article.
