【摘要】：不动产物权统一登记制度的建立和完善,不仅关系到公民个人相关财产权益,而且关系到市场经济的安全和国家宏观调控政策的制定。但是,现行多头登记、各自为政的不动产物权统一登记状态,不利于保护当事人合法权益以及交易安全。本文主要分为四个部分对我国的不动产物权统一登记制度进行论述。第一部分主要论述了现行不动产登记的弊端以及要进行不动产物权统一登记的原因;第二部分主要论述了不动产统一登记的方法,包括属地主义与属人主义;第三部分主要列举了一些不动产物权统一登记的客体以及分析了进行不动产登记以后会产生怎样的效力,这些客体包括土地、房屋、林权、矿权、路权;最后一部分主要是针对以上的分析,给出完善我国不动产物权统一登记制度的立法建议。
[Abstract]:The establishment and perfection of the unified registration system of real estate right not only relates to the rights and interests of the individual, but also to the security of the market economy and the formulation of the national macro-control policy. The state of registration of the real property rights of each of them is unified. This paper is divided into four parts to discuss the unified registration system of real property right in our country. The first part mainly discusses the malpractice of current real estate registration. The reasons for unified registration of real property rights; The second part mainly discusses the real estate unified registration method, including territorialism and personal doctrine; The third part mainly enumerates some real estate real right unified registration object and analyzes how the real estate registration will be effective, these objects include land, housing, forest rights, mining rights, road rights; The last part is mainly aimed at the above analysis, and gives the legislative suggestions to perfect the unified registration system of real estate right in our country.
