论我国个人信息保护制度的立法完善

【摘要】：我国对个人信息的保护尚处于起步阶段,虽然已制定了许多与个人信息保护相关的法律,但目前的个人信息保护制度仍不完善,立法并不健全,主要问题包括:个人信息保护法的立法进度缓慢、现有立法不成体系且适用范围有限、重刑事行政处罚轻民事归责、缺乏个人信息跨境流通方面的规定、对垃圾商业信息的处罚不明、对政府机构的约束不足。对此,我国应当从以下八个方面进行立法完善:尽快制定专门的个人信息保护法、制定个人信息保护技术的国家标准、鼓励制定行业性自律规范作为个人信息保护法律的有益补充、完善侵犯个人信息行为的民事归责制度、制定个人信息跨境流通的规范、加强对电信运营商的监管、加重对滥发商业性信息的处罚力度、规制政机构对个人信息的收集和使用、设立个人信息保护咨询委员会。
[Abstract]:The protection of personal information in China is still in its infancy. Although many laws related to the protection of personal information have been formulated, the current system of personal information protection is still imperfect and the legislation is not perfect. The main problems include: the slow legislative progress of personal information protection law, the existing legislation is not systematic and limited scope of application, heavy criminal administrative punishment less civil imputation, lack of personal information cross-border circulation provisions. The punishment of the garbage commercial information is unclear, and the restriction to the government organization is insufficient. Therefore, our country should perfect the legislation from the following eight aspects: to formulate the special personal information protection law as soon as possible. To establish national standards for personal information protection technology, encourage the establishment of industry self-discipline norms as a useful supplement to personal information protection laws, and improve the civil liability system for violations of personal information. We should establish norms for the cross-border circulation of personal information, strengthen the supervision of telecom operators, increase the penalties for the indiscriminate distribution of commercial information, and regulate the collection and use of personal information by government agencies. Establish the personal Information Protection Advisory Committee.
