【摘要】：随着国人消费水平的提高,愈来愈多的国际知名商品进入了大家的视野,相关的知名商标也被大家所熟知。为抢占中国这片广阔的市场,外国企业大刀阔斧的将其产品、商标以及文化输入到中国,以打造商标这张“黄金名片”。外文商标在进入中国市场后,一个既能表述产品功能与特色,又符合中国语言文化的中文译名能使消费者迅速熟知该商标,但如果该外文商标或其中文译名在中国未经注册,则有可能被相同或类似商品上的其他生产者进行注册或被用作企业名称、域名,纠纷于是乎产生。在处理外文商标的相关纠纷时,也面临着对一些特殊问题的处理,如在先注册的未驰名商标与未注册驰名外文商标之间的冲突与协调、外文商标中文译名的使用必须是主动使用还是被动使用。对这些特殊问题的解答,是研究外文商标法律保护问题难以回避的问题,也有利于完善我国商标领域的相关制度:如商标与企业名称、域名的交叉检索制度、商标善意共存制度,以建立一个更加开放、公平的市场环境,同时为我国企业的商标国际化策略提供借鉴,推动企业建立符合实际的商标战略。本文即聚焦外文商标在进入中国市场中所面临的典型的、特定的问题。第一章主要介绍本文所指的外文商标及其特点、外文商标的中文译名以及外文商标的相同商标、近似商标的判断;第二章通过典型案例介绍了未注册外文商标在中国被利用的几种情形;第三章总结了司法实践中保护未注册外文商标的几种路径及法律依据;第四章是对未注册外文商标的保护中几个特殊问题的分析;第五章在总结前面四章内容的基础上提出完善我国商标制度的构想以及对我国企业的启示。
[Abstract]:With the improvement of people's consumption level, more and more international well-known commodities have entered the field of vision, and the related well-known trademarks are also well known to all, in order to seize the vast market of China. In order to create a "golden business card", foreign enterprises have been aggressively importing their products, trademarks and culture into China. After entering the Chinese market, a foreign language trademark can express the functions and characteristics of the products. A Chinese translation in accordance with the Chinese language and culture enables consumers to quickly become familiar with the trademark, but if the foreign language trademark or its Chinese translation is not registered in China. It may be registered by other producers of the same or similar goods or used as enterprise name, domain name, and disputes arising therefrom. It also faces some special problems, such as the conflict and coordination between the unregistered well-known trademark and the unregistered well-known foreign language trademark. The use of Chinese translated names of foreign trademarks must be active or passive. The solution to these special questions is an unavoidable problem to study the legal protection of foreign trademarks. It also helps to perfect the related systems in the field of trademark in China, such as trademark and enterprise name, cross-search system of domain name, co-existence of trademark in good faith, in order to establish a more open and fair market environment. At the same time, it provides reference for the internationalization strategy of Chinese enterprises, and promotes the establishment of a trademark strategy that is in line with the reality. This paper focuses on the typical foreign language trademark in entering the Chinese market. The first chapter mainly introduces the foreign language trademark and its characteristics, the Chinese translation of the foreign language trademark and the judgment of the same trademark and similar trademark of the foreign language trademark; The second chapter introduces several cases in which unregistered foreign language trademarks are used in China. The third chapter summarizes the judicial practice of the protection of unregistered foreign language trademark several ways and legal basis; Chapter 4th is the analysis of several special problems in the protection of unregistered foreign trademarks. Chapter 5th, on the basis of summarizing the contents of the previous four chapters, puts forward the idea of perfecting the trademark system of our country and its enlightenment to the enterprises of our country.
