【摘要】：近年来,随着科学技术的不断发展,互联网烙印下的时代每天都发生着一系列的重大变化,这对于著作权人来说是悲喜交加的时代,因为信息网络传播权人的合法利益在技术面前既是机遇,也是挑战。虽然我国《著作权法》对信息网络传播权的定义较为明确,但毕竟科技已经更迭了很多年,不免有些滞后。如今的信息网络传播权的侵权方式也有了许多新的方式和手段,在巨额的IP交易成本及低廉的侵权成本面前,猖獗的网络侵权人肆无忌惮地通过为侵权行为披上技术的外衣的方式侵害着信息网络传播权人的合法权益。面对这些来自现实的挑战,如何建立合理的信息网络传播权的侵权责任标准便是一个值得思考的问题了。2016年4月国家版权局副局长阎晓宏指出,“今后相当长一段时间我国将处于版权矛盾纠纷高发期,网络版权保护将有很长的路要走”。本文采用了文献分析法、案例分析法进行研究,在对一些具体案件深入分析的基础上试图阐明信息网络传播权的基本概要,分析信息网络传播权的具体侵权行为等,深入分析信息网络传播权的侵权责任归责原则及要件,发现目前我国法律中存在的问题,以此提出一些解决思路。本文分为五部分:第一部分为引言,主要包括选题目的、选题意义、国内外研究现状、研究方法、研究思路以及本文的创新点等内容。引言部分通过对国内此问题的研究现状以及研究方法、研究思路的介绍,为本文的写作奠定了扎实的理论基础。第二部分为介绍信息网络传播权的概念特征及立法现状,着重介绍了信息网络传播权侵权责任的特点,对信息网络传播权的基本情况做一个介绍。第三部分介绍信息网络传播权的侵权行为特点及表现方式,其中夹杂着丰富的案例,以此使理论和实际联系更紧密,生动地放映出侵害信息网络传播权的场景。第四部分是重点章节,分析信息网络传播权的归责原则之争的问题,以此为背景找出目前我国立法在信息网络传播权方面存在的问题。第五部分试图针对现实存在的问题,在立法层面,提出一些解决思路。
[Abstract]:In recent years, with the continuous development of science and technology, the era under the brand of the Internet is undergoing a series of major changes every day, which is a sad and happy time for copyright owners. Because the legitimate interests of the information network communication right are both opportunities and challenges in front of technology. Although the definition of information network communication right is relatively clear in the copyright Law of our country, after all, science and technology have changed for many years. Nowadays, there are many new ways and means of infringing the right of information network communication, which are facing the huge cost of IP transaction and the low cost of infringement. Rampant network infringers are infringing upon the legitimate rights and interests of information network communicators through the way of putting technology on the cover of infringing acts. In the face of these challenges from reality. How to establish a reasonable standard of tort liability of information network communication right is a problem worth thinking about. In April 2016, Yan Xiaohong, deputy director of the National copyright Bureau, pointed out. "for a long time in the future, China will be in a period of high copyright contradictions and disputes, and the network copyright protection will have a long way to go". This paper adopts the literature analysis method, case analysis method to study. On the basis of in-depth analysis of some specific cases, this paper attempts to clarify the basic outline of the right of information network communication, analyzes the specific infringement of the right of information network communication, and so on. Deeply analyze the principles and requirements of tort liability of information network communication right, find out the existing problems in our country's law, and put forward some solutions. This paper is divided into five parts: the first part is the introduction. Including the purpose of the topic, the significance of the topic, domestic and foreign research status, research methods, research ideas and innovative points in this paper. The introduction through the domestic research on this issue and research methods. The introduction of research ideas for the writing of this paper laid a solid theoretical foundation. The second part is to introduce the concept of information network communication rights and the status quo of legislation, focusing on the characteristics of information network communication rights tort liability. The third part introduces the characteristics and manifestations of the infringement of information network communication right, which is mixed with a wealth of cases, in order to make the theory and practice more closely linked. Vividly project the scene of infringing the right of information network communication. Part 4th is the key chapter to analyze the dispute of the principle of imputation of the right of information network communication. Based on this background, this paper finds out the problems existing in the current legislation of our country in the aspect of information network communication right. Part 5th tries to solve the problems in reality and puts forward some solutions in the aspect of legislation.
