企业责任风险的化解体系

【摘要】：现代社会,企业改变了社会交往中的主体形态,成为主要的风险源,侵权法将多种责任风险分配给企业。作为一种风险转移机制,保险变个体应对风险为群体共同承担风险,使那些不分散风险就很难存续的经济活动成为可能,责任保险成为企业化解各种责任风险的主要形式。对于企业大规模侵权活动,损害赔偿基金能实现救济受害人、化解企业责任风险和维护社会公平与稳定的目标。在许多企业责任领域,公法尤其是行政法以行政命令、安全监察、税收负担等形式是更高效的风险预防手段,与典型的私法分散风险形式构成了多制度协同作用的责任风险化解体系。
[Abstract]:In modern society, enterprises have changed the main form of social communication and become the main source of risk. Tort law distributes a variety of liability risks to enterprises. Make possible those economic activities that are difficult to survive without dispersing risks, and liability insurance becomes the main form in which enterprises defuse all kinds of liability risks. For large-scale tort activities of enterprises, the damage compensation fund can help the victims. In many areas of corporate responsibility, public law, especially administrative law, is a more efficient means of risk prevention in the form of administrative orders, security supervision, tax burden, etc. And the typical private law decentralized risk forms constitute the responsibility risk solution system of multi-system synergy.
