日本职务发明的贡献度问题研究

【摘要】:职务发明的利益分配是职务发明机制的重要组成部分,在调整企业与雇员间的利益平衡、推动创新型国家建设方面都具有非凡的意义。其中职务发明贡献度已被日本等国列入计算职务发明奖酬时应考虑的内容。结合日本职务发明权利归属与奖酬机制的演变,就贡献度对雇员发明创造积极性的作用进行探讨,以便于细化我国职务发明制度具体标准时参考和研究。
[Abstract]:The distribution of benefits of job invention is an important part of the mechanism of job invention, which adjusts the balance of interests between enterprises and employees. It is of great significance to promote the construction of an innovative country. Among them, the degree of contribution of job inventions has been included in the contents that should be considered in the calculation of the compensation for job inventors in Japan and other countries, in combination with the ownership of the rights of Japanese job inventions and the evolution of the reward and remuneration mechanism. This paper probes into the effect of contribution degree on employee's initiative of invention and creation so as to facilitate the reference and study of the detailed standards of the system of job invention in China.
