【摘要】：网络环境下的著作权问题主要是著作权人的著作权在网络空间无限扩大与社会公众对权利扩张的反对和限制之间利益的平衡问题。著作权合理使用制度是限制著作权人无限扩张权利的制度,该制度明确了著作权合理使用人合法“侵犯”著作权,“损害”著作权人的利益,而这种“侵犯”、“损害”正好限制了著作权人权利的扩张,在扩张与限制之中形成动态的利益平衡。这种平衡具有正当合理性。在网络环境下,著作权的合理使用也需要平衡彼此之间的利益,因而研究在网络环境下如何判断著作权的合理使用具有重要的理论价值和实践意义。《保护文学艺术作品伯尔尼公约》(以下简称《伯尔尼公约》)第九条规定的“三步检验法”是判断著作权合理使用的一般原则,其被TRIPs协议吸收后,更为各WTO成员国相关立法所遵守。美国基于其独特的法律文化和实践形成的“四要素”,在具体案件中为著作权的合理使用提供了更加细化的判断标准。在网络环境下,对著作权合理使用的判断仍然适用“三步检验法”和“四要素”,二者相辅相成,以“三步检验法”为判断的一般原则,以“四要素”为判断的参考标准,同时结合实际需要,科学合理判断和规制网络环境下著作权的合理使用。全文包括引言和结语共分为五部分。第一部分,首先简要介绍研究网络环境下著作权合理使用的背景和意义;其次综述研究文献,梳理相关研究成果,为进一步深入研究作准备;最后介绍研究的思路和主要创新之处。为以下各部分展开研究打下基础。第二部分,探讨网络环境下著作权合理使用的一般判断原则——“三步检验法”。首先正本清源,探寻把握“三步检验法”的基本含义;其次浅析国内外相关立法对“三步检验法”的吸收与融合;最后深入分析和探讨网络环境下如何适用“三步检验法”判断著作权合理使用。第三部分,探讨网络环境下著作权合理使用的参考标准——“四要素”。首先在网络环境下,著作权合理“使用的目的和性质”应当进一步细化;其次对网络环境下“被使用作品的性质”应当有所扩充;再次仍然应当坚持对网络环境下作品“被使用部分的数量和质量”判断标准;最后应当更进一步强化网络环境下使用作品“对作品市场的潜在影响”作判。第四部分,从司法的角度探讨网络环境下著作权合理使用。对网络环境下著作权合理使用的判断,在司法实践中,既有对“三步检验法”原则的遵守和“四要素”的坚持,也有对司法价值选择倾向性的灵活适用,突破现有的立法规定,倾向于对公众利益的更加重视。第五部分,作结全文。“三步检验法”和“四要素”仍适用于网络环境下对著作权合理使用的判断,“三步检验法”仍然是判断的一般原则,“四要素”是判断的参考标准;二者有机融合,结合司法实践需要,实现科学合理判断和规制网络环境下对著作权的合理使用。
