【摘要】：酒后代驾既有利于保护代驾人的生命财产安全,又有利于降低交通事故发生的概率,维持社会的正常秩序,酒后代驾行业的兴起具有其必然性和合理性。但是由于我国相关立法的缺失,酒后代驾过程中极易发生各种纠纷并且纠纷的解决也极为困难。为了保护酒后代驾市场上各个主体的合法权利,减少纠纷的发生,在酒后代驾市场上营造和谐稳定的环境,本文结合实践中存在的各种问题,对酒后代驾合同进行了探讨。酒后代驾合同作为一种新型合同,在合同当事人的主体资格、合同的形式与内容、合同的法律性质和合同的违约责任方面都存在争议,亟待解决。本文就从这四个角度对酒后代驾合同进行了分析,在当事人的主体资格部分以完善代驾人的市场准入和被代驾人在醉酒状态下缔约能力的认定为重点,在合同的形式与内容部分以对格式条款的规制和明确合同当事人的权利义务为重点,之后又在明确权利义务关系的基础上界定了酒后代驾合同的法律性质和法律适用规则,并对合同当事人的违约责任进行了分析。文章的创新点有两个：一是被代驾人缔约能力的认定；二是酒后代驾合同法律性质的认定。通过借鉴国外立法规定,分析各个理论学说,最终认定被代驾人在醉酒状态下缔结的酒后代驾合同具有缔约能力,合同有效,并且酒后代驾合同不同于任何一种有名合同,是一种独立的新型的无名合同。笔者大体采用了资料分析法、比较分析法、案例分析法和综合分析法等研究方法。首先,查阅酒后代驾合同有关的国内外立法规定和典型案例,了解各家理论学说；然后,对国内外立法规定和各个学说进行比较分析,对典型案例进行深入研究；最后对酒后代驾合同中存在的问题进行综合分析,并得出自己的见解。
[Abstract]:Drinking and driving for future generations is not only conducive to the protection of the life and property of substitute drivers, but also to the reduction of the probability of traffic accidents and the maintenance of normal social order. The rise of future generations of wine driving industry has its inevitability and rationality. However, due to the lack of relevant legislation in China, In order to protect the legal rights of all the subjects in the market and reduce the occurrence of disputes, it is easy to create a harmonious and stable environment in the future generations driving market. Combined with various problems existing in practice, this paper discusses the driving contract of alcoholic descendant. As a new type of contract, as a new type of contract, the main qualification of the parties to the contract, the form and content of the contract, the form and content of the contract. The legal nature of the contract and the liability for breach of contract are controversial, which are urgently needed to be solved. In the part of the subject qualification of the party concerned, the emphasis is on perfecting the market access of the driving agent and the determination of the contracting ability of the acting driver under the drunken condition. The form and content of the contract focus on the regulation of the form clause and the rights and obligations of the parties to the contract, and then on the basis of defining the relationship between the rights and obligations, the author defines the legal nature and applicable rules of the contract. There are two innovative points in the article: one is the determination of the contracting ability of the person being driven on behalf, the other is the determination of the legal nature of the driving contract of the descendant. After analyzing various theories and theories, it is concluded that the contract concluded by the substitute driver under the condition of drunkenness has the ability to make a contract, and the contract is valid, and the contract is different from any famous contract. It is an independent new type of nameless contract. The author has generally adopted the methods of data analysis, comparative analysis, case analysis and comprehensive analysis. First of all, I refer to the domestic and foreign legislative provisions and typical cases related to the driving contract for future generations of wine. Understand the various theories; then, the domestic and foreign legislative provisions and each theory comparative analysis, in-depth study of typical cases; finally, the wine offspring driving contract problems in a comprehensive analysis, and get their own views.
