著作权重复转让中的权属认定

【摘要】：明确著作权转让公示规则是建立著作权重复转让中权属认定规则的前提。设立著作权转让登记制度有利于交易安全,且不违反《伯尔尼公约》。基于我国著作权登记制度不完善的现状以及交付在著作权转让中的局限性,著作权转让应采取意思主义、登记对抗模式。在此基础上,依据权利转移与救济规则适度分离的构建路径,应明确登记对抗效力在于促使受让人在取得著作权的竞争中获得胜利,著作权法通过均衡著作权转让中的多元价值来设计竞争指标。如先受让人先登记,由先受让人取得著作权;先受让人未登记,后受让人符合如下要件可取得著作权:已登记并系有偿受让,除非其明知先受让人存在且其主张登记违反诚实信用原则。
[Abstract]:The establishment of copyright transfer registration system is beneficial to the security of trade. And not in violation of the Berne Convention. In view of the imperfect present situation of the copyright registration system in China and the limitations of delivery in the transfer of copyright, the transfer of copyright should adopt the doctrine of will and the mode of registration confrontation. On this basis, According to the construction path of moderate separation of rights transfer and relief rules, it should be made clear that the effectiveness of registration confrontation lies in promoting the transferee to win in the competition to obtain copyright. Copyright law designs competition targets by balancing the multiple values in the transfer of copyright. If the first transferee registers first, the prior transferee acquires the copyright; the prior transferee does not register, The latter transferee may acquire copyright by following conditions: registered and paid transfer unless he knows that the prior transferee exists and claims registration is contrary to the principle of good faith.
