典型合同与合同法分则的完善

【摘要】：正按照两步走的部署,民法典分则编的编纂将拉开帷幕。在这一过程中,体系性整合成为最为重要的工作。与此同时,法典的编纂,也是反思现有单行法不足并加以完善的最为重要的时机之一。其中,作为相对成熟的合同法,如何纳入民法典以及纳入民法典时当如何处理相关的章节,等等,必将成为重要的内容之一。这其中会涉及《合同法》总则编与《民法总则》法律行为编的协调问
[Abstract]:In accordance with the two-step arrangement, the codification of the Civil Code provisions will begin. In this process, systematic integration becomes the most important work. At the same time, the codification of the Code, It is also one of the most important opportunities to reflect on the shortcomings of the existing single law and to perfect it. Among them, as a relatively mature contract law, how to incorporate the Civil Code and how to deal with the relevant chapters when it is incorporated into the Civil Code, and so on, It will certainly become one of the important contents. This will involve the coordination between the General provisions of contract Law and the General principles of Civil Law.
