【摘要】：随着我国综合国力的不断发展,我们国家的旅游业也处在一个蓬勃发展的时期,旅游已经成为人们生活娱乐和休闲的主要内容。在此背景下,新的《旅游法》颁布实施了,这部法律极大的保护了旅游者的权利,对旅游市场上长期存在的问题做出了严格的规定,这表明中国的旅游业已经进入了一个有法可依的新时代。本文主要是以新的《旅游法》实施为背景,以旅游经营者的责任为切入点,先对旅游合同中的经营者承担责任的理论基础和承担责任的类型做出了详细的分析,然后阐述了新的法律关于经营者责任的规定以及所存在的漏洞与问题,并借鉴国外的一些法律法规中关于经营者责任的规定,提出一些具体的法律完善措施。另外,本文在谈到经营者承担责任的问题时,同时也兼顾到了经营者责任的限制问题,以防止旅游消费者权利的滥用,以此来达到双方利益的一种平衡,力求最大限度的实现公平正义的目标,这样才能保证旅游业市场持久、健康的发展。
[Abstract]:With the continuous development of China's comprehensive national strength, our country's tourism industry is also in a period of vigorous development. Tourism has become the main content of people's life, entertainment and leisure. Under this background, the new Tourism Law has been promulgated and implemented. This law greatly protects the rights of tourists and provides strict regulations on the long-standing problems in the tourism market. This indicates that China's tourism industry has entered a new era in which there are laws to be followed. This paper mainly takes the implementation of the new Tourism Law as the background and the responsibility of tourism operators as the starting point. First of all, it makes a detailed analysis of the theoretical basis and the types of responsibility of the operators in the tourism contract, and then expounds the provisions of the new law on the responsibility of the operators, as well as the loopholes and problems that exist. And draw lessons from some foreign laws and regulations on the responsibility of the operator, put forward some specific legal measures to improve. In addition, this article talked about the problem of the operator to bear responsibility, but also took into account the limitation of the responsibility of the operator. In order to prevent the abuse of tourism consumers' rights, to achieve a balance between the interests of both sides, and strive to achieve the goal of fairness and justice to the maximum extent, so as to ensure the sustained and healthy development of the tourism market.
