网络侵权治理的中国经验及完善建议

【摘要】：通过对网络侵权治理20多年实践经验的分析发现,各国网络侵权治理呈现出网络用户中心主义和网络服务提供者中心主义两种模式,前者的制度设计围绕追究网络用户侵权责任展开,后者则试图通过对网络服务提供者的规制来促使其积极采取措施以消减网络中的侵权。中国对网络侵权的治理方式属于较为典型的网络服务提供者中心主义模式,但也呈现出自身的一些特点,比如网络服务提供者和网络用户承担连带责任、网络服务提供者侵权责任名重而实轻、将事实上不追究网络用户责任作为制度设计潜在承认的现实等。中国未来网络侵权治理的完善,需从逐渐将网络用户纳入侵权责任追究对象、适时调整侵权损害赔偿金额、支持技术保护措施发展、对入口性的关键网站予以重点关注等方面展开。
[Abstract]:Through the analysis of more than 20 years' practical experience of network tort governance, it is found that there are two modes of network user-centrism and network service provider centralism in the governance of network tort in various countries. The system design of the former revolves around investigating the tort liability of network users. The latter tries to regulate the network service providers to make them take active measures to reduce the infringement in the network. The governance mode of network infringement in China belongs to the more typical mode of network service provider centrism. But it also shows some characteristics, such as network service provider and network user bear joint liability, network service provider tort liability is heavy and light, To regard the fact that the responsibility of network users is not investigated as a reality of potential recognition in system design, and so on. In order to improve the governance of network infringement in the future in China, it is necessary to gradually bring network users into the object of investigation of tort liability, and adjust the amount of compensation for infringement damage in due course. Support the development of technical protection measures and focus on key web sites.
