住宅小区停车位权属问题研究

【摘要】：随着经济的快速发展,我国居民生活水平提高,对很多居民来讲,购买私家车已不再是难以实现的梦想,私家车的保有量逐年递增,然而现实中停车位的建设速度却跟不上私家车增长的速度,现有的停车位难以满足人们的正常停车需求,因停车位的使用和归属已引发了一系列纠纷。2007年出台的《物权法》虽对停车位的归属进行了规定,但总体来说过于原则,不能完全满足司法实践中纠纷解决的需要,对停车位权属的界定问题仍有待进一步研究和探讨。本文通过比较分析和实证研究等方法,集中探讨我国小区停车位权利界定问题。除绪论外,本文总共分为五个部分。第一部分在分析建筑物区分所有权的含义和内容的基础上,介绍了停车位的概念、种类及性质等问题。第二部分在分析停车位权属界定应遵循的原则的基础上,探讨并论证了关于停车位权属界定的不同标准及不同类型停车位的权利归属问题。第三部分通过分析不同国家和地区的停车位权属制度,总结并提出了对我国停车位权利界定的借鉴意见。第四部分先分析了我国停车位权利归属的现状,然后总结并分析了我国目前有关住宅小区停车位的立法情况,最后重点分析我国《物权法》第74条的合理性及不足之处。第五部分重点针对我国住宅小区停车位的权利界定提出了相应的完善建议,如明确法律规定,完善登记制度等。
[Abstract]:With the rapid development of economy, the living standards of Chinese residents have been improved. For many residents, the purchase of private cars is no longer an elusive dream, and the number of private cars is increasing year by year. However, in reality, the construction speed of parking spaces can not keep pace with the growth of private cars, and the existing parking spaces are difficult to meet the normal parking needs of people. The use and attribution of parking spaces has led to a series of disputes. Although the property Law issued in 2007 provides for the ownership of parking spaces, it is generally too principled to fully meet the needs of dispute resolution in judicial practice. The definition of the ownership of parking spaces still needs further study and discussion. This paper, by means of comparative analysis and empirical research, focuses on the definition of parking space rights in residential areas in China. This paper is divided into five parts. The first part introduces the concept of parking space on the basis of analyzing the meaning and content of building ownership. The second part is based on the analysis of the principles to be followed in defining the ownership of parking spaces. This paper discusses and demonstrates the different standards of the definition of ownership of parking spaces and the right attribution of different types of parking spaces. The third part analyzes the system of ownership of parking spaces in different countries and regions. The fourth part analyzes the status quo of the right of parking space in our country, and then summarizes and analyzes the legislation of parking space in residential area. Finally, the rationality and deficiency of Article 74 of Real right Law of our country are analyzed emphatically. The fifth part puts forward the corresponding perfect suggestion to define the right of parking space in residential district of our country, such as clear law regulation, perfect registration system and so on.
