论吸毒人员的权利保障存在的问题及成因

【摘要】：尽管吸毒是我国法律所打击的违法行为,但从人权保障的角度看,在我国宪法和法律中吸毒人员的权利与普通公民一致。现实生活中,吸毒人员因其违法行为被贴上"瘾君子"等标签而被社会所歧视和排斥,其应该享有的各种公民权利也经常被侵犯,难以得到有效的保障。究其原因,既有吸毒人员自身权利意识淡薄,也有社会性歧视、家庭温暖的缺失、法律执行力度薄弱等因素。
[Abstract]:Although drug abuse is an illegal act in China's law, from the perspective of human rights protection, the rights of drug addicts in our constitution and law are the same as those of ordinary citizens. In real life, drug addicts are discriminated against and excluded from the society because of their illegal behavior being labeled as "addicts", and all kinds of civil rights should be enjoyed by the drug addicts. It is often violated, and it is difficult to get effective guarantee. The reasons are not only the weak consciousness of the rights of the drug addicts, but also the social discrimination, the lack of family warmth, and the weak enforcement of the law.
