基于政府管理视角的大数据环境下个人信息保护问题研究

【摘要】：当前大数据环境下的个人信息保护是社会关注的焦点问题,解决好该问题对于保障公民合法权利,促进大数据产业健康发展具有十分重要的意义。本文基于政府管理的视角,从法律法规体系、全流程的监管体系、跨境数据流动处理以及多元治理机制等不同方面,分析了我国政府在应对大数据环境下个人信息保护问题中存在的管理问题,并通过借鉴具有典型代表意义的美国和欧盟在处理该问题上的经验,提出了相应的改进建议,以及促进大数据环境下个人信息保护的对策。
[Abstract]:The protection of personal information under the environment of big data is the focus of attention of the society. It is of great significance to solve this problem to protect the legal rights of citizens and promote the healthy development of big data industry. This paper is based on the perspective of government management, from different aspects, such as the system of laws and regulations, the regulatory system of the whole process, the processing of cross-border data flow and the mechanism of multiple governance, etc. This paper analyzes the management problems of Chinese government in dealing with the protection of personal information under the environment of big data, and puts forward corresponding suggestions for improvement by drawing lessons from the experiences of the United States and the European Union, which are typical representatives, in dealing with this problem. And to promote big data under the environment of personal information protection countermeasures.
