工伤保险补偿与第三人侵权损害赔偿竞合处理问题研究

【摘要】：20世纪80年代以后,随着中国社会经济的快速发展,工伤事故频频地发生,工伤案件补偿请求权的竞合问题也较为常见。其中因为第三人侵权行为而引起的工伤事故的赔偿问题尤为典型,不仅理论上存在重大争议,司法实践中也因地域差异和法官素质差异而多有不同,如何处理人身损害赔偿与工伤保险待遇的竞合问题是一大难题。究其根本,当从处理模式的角度入手解决为宜。在分析、比较和借鉴相关国家先进立法经验的基础上,权衡利弊,结合国情,我们主张我国应该适用补充模式的方式来处理人身伤害赔偿与工伤保险待遇之间的竞合问题,并主张在理论成熟的基础之上推进相关的立法规范修正。以有效地保护劳动者合法权益的同时又能够兼顾社会公平正义。
[Abstract]:Since the 1980s, with the rapid development of China's social economy, industrial accidents occur frequently, and the problem of competing claims for compensation in industrial injury cases is also more common. The compensation problem caused by the third party's tort is especially typical, which is not only controversial in theory, but also different in judicial practice due to regional differences and judges' quality differences. How to deal with personal injury compensation and industrial injury insurance is a major problem. The root of the problem should be solved from the point of view of processing mode. On the basis of analyzing, comparing and drawing lessons from the advanced legislative experience of relevant countries, weighing the advantages and disadvantages and combining with the national conditions, we advocate that our country should apply the supplementary mode to deal with the problem of competing between personal injury compensation and industrial injury insurance treatment. And on the basis of theoretical maturity to promote the relevant legislative and normative amendments. In order to effectively protect the legitimate rights and interests of workers at the same time can take into account social equity and justice.
