浅析老龄化社会下老年人的权益保护

【摘要】：我国自古以来就有着敬老的传统美德,随着社会的发展,我国逐渐进入老龄化社会,人口老龄化的问题越来越明显。如何保障老年人权益备受关注。老年人权益保障的问题不仅是家庭的问题,更是整个国家和社会的问题,关系到每家每户,关系到国计民生,也与改革、发展、稳定的大局密切相关。因此,当前的法治社会背景亟需建立一套完善的老年人权益保障法律体系和健全的相关配套措施。本文旨在通过对老龄化社会和老年人权益基础理论的研究,以及对域外先进国家相关经验的借鉴,分析我国老年人权益保障现状中存在的不足,来探讨我国当前形势下所需要的老年人权益保障法律体系和相关配套措施,主要分五个部分进行阐述。第一部分为老龄化社会与老年人权益。首先对人口老龄化的衡量标准作出了界定,同时也简要介绍了我国目前的老龄概况。接着从经济发展、社会安全、家庭保障、社会保障和老年人自身发展等不同方面,对老龄化社会下存在的诸多问题做了简要的分析。其次,从基础理论的立足点出发,不仅对老年人的界定以及我国老年人权益保障法所采用的界定标准作了介绍,而且重点阐述了老年人权益的基本内容。第二部分为老年人权益保障的思想渊源和现实基础。首先从人道主义道德基础和社会契约理论基础两个方面对老年人权益保障的思想渊源作了论述。然后从老龄化社会的现实需要和可持续发展社会的内在要求两个角度对老年人权益保障的现实基础作了合理地分析。第三部分为域外先进国家的老年人权益保障现状。该部分首先介绍了国外老年人权益立法保障模式的概况,即域外先进国家所存在的两种老年人权益立法保障模式——分散式和专门式老年人权益立法保障模式。然后以美国、德国、瑞典、日本和韩国为例,介绍了国外先进的老年人权益保护经验,以期从比较法的角度我国的老龄工作指明道路,帮助完善我国的相关制度。第四部分为我国老年人权益保障法律体系概况。首先介绍了我国现行的老年人权益保障法律体系的基本构成。然后重点分析了现行老年人权益法律保障体系中存在的一些缺陷。第五部分为完善老年人权益保障和救济制度的思考。在前四个部分的基础上,从完善老年人权益保障的相关法律制度、建立健全相关配套措施和完善老年人权益保障的其它构想三个大的方面对我国当前形势下老年人权益保障法律制度体系和相关配套措施的建设提出笔者的一些建议和构想。
[Abstract]:Since ancient times, our country has the traditional virtue of respecting the elderly. With the development of society, our country has gradually entered the aging society, and the problem of population aging is becoming more and more obvious. How to protect the rights and interests of the elderly has attracted much attention. The protection of the rights and interests of the elderly is not only a family issue, but also a problem for the whole country and society. It concerns every household, the national economy and the people's livelihood, and is closely related to the overall situation of reform, development and stability. Therefore, it is urgent to establish a perfect legal system and relevant supporting measures for the protection of the rights and interests of the elderly in the current legal background of the rule of law. The purpose of this paper is to study the basic theory of aging society and the rights and interests of the elderly, as well as to draw lessons from the relevant experiences of overseas advanced countries, and to analyze the shortcomings in the present situation of the protection of the rights and interests of the elderly in China. This paper discusses the legal system of the protection of the rights and interests of the elderly and related supporting measures under the current situation of our country, which is mainly divided into five parts. The first part is the aging society and the rights and interests of the elderly. Firstly, the paper defines the standard of population aging, and also briefly introduces the current situation of aging in China. Then, from the aspects of economic development, social security, family security, social security and the development of the elderly themselves, this paper makes a brief analysis of many problems existing in the aging society. Secondly, from the standpoint of basic theory, this paper not only introduces the definition of the elderly and the defining standards adopted by the Law on the Protection of the Rights and interests of the elderly in China, but also expounds the basic contents of the rights and interests of the elderly. The second part is the ideological origin and realistic basis of the protection of the rights and interests of the elderly. Firstly, this paper discusses the ideological origin of the protection of the rights and interests of the elderly from the two aspects of the humanitarian moral basis and the theoretical basis of the social contract. Then the realistic foundation of the protection of the rights and interests of the elderly is analyzed reasonably from the realistic needs of the aging society and the internal requirements of the sustainable development society. The third part is the status quo of the protection of the rights and interests of the elderly in advanced countries. This part first introduces the general situation of the foreign legislative protection mode of the rights and interests of the elderly, that is, there are two kinds of legislative protection modes of the rights and interests of the elderly in foreign advanced countries, namely, the decentralized mode and the specialized mode of the legislative protection of the rights and interests of the elderly. Then taking the United States, Germany, Sweden, Japan and South Korea as an example, this paper introduces the advanced foreign experiences of protecting the rights and interests of the elderly, in order to point out the way of our country's aging work from the perspective of comparative law, and to help improve the relevant system of our country. The fourth part is an overview of the legal system of the protection of the rights and interests of the elderly in China. First of all, it introduces the basic constitution of the current legal system of the protection of the rights and interests of the elderly in our country. Then it analyzes some defects in the current legal protection system of the rights and interests of the elderly. The fifth part is to perfect the old people's rights and interests protection and relief system. On the basis of the first four parts, from the perspective of perfecting the relevant legal system for the protection of the rights and interests of the elderly, The author puts forward some suggestions and ideas on the construction of the legal system of the protection of the rights and interests of the elderly under the current situation in our country and the construction of the relevant supporting measures from three aspects: establishing and perfecting the relevant supporting measures and other ideas of perfecting the protection of the rights and interests of the elderly.
