我国不动产善意取得的制度构建

【摘要】：动产与不动产善意取得制度在我国《物权法》中被合并做了同一性规定,适用几乎相同的构成要件,学界对此做了较为充分的研究。结合已有研究成果,作者运用比较法资料,在制定民法典物权编的时代背景下,特别针对物权法上善意取得的制度构建,在综合分析了动产与不动产善意取得的制度原理与构成要件异同之后,提出了动产与不动产善意取得制度应相互独立的观点,探讨了善意取得制度在未来物权法编的具体位置安排,并拟定了不动产善意取得的相关法律条文。
[Abstract]:The system of acquisition of movable property and immovable property in good faith has been combined in the property Law of our country to provide for identity, which is applicable to almost the same constituent elements, which has been fully studied by academic circles. Combined with the existing research results, the author uses comparative law materials, in the context of the formulation of the civil code, especially in the context of the establishment of the system of bona fide acquisition in property law. After a comprehensive analysis of the similarities and differences between the principles and elements of bona fide acquisition of movable property and immovable property, this paper puts forward the view that the system of bona fide acquisition of movable and immovable property should be independent of each other. This paper discusses the arrangement of bona fide acquisition system in the future property law, and formulates the relevant legal provisions of bona fide acquisition of real estate.
