图形用户界面（GUI）外观设计专利保护研究

【摘要】：随着科学技术水平的提高,除了优秀的性能和造型之外,图形用户界面已成为了消费者选购现代电子产品的重要因素。而2014年修订的《专利审查指南》已正式将图形用户界面纳入外观设计专利保护。全文共分为三章。第一章主要是对图形用户界面进行介绍。简单介绍了图形用户界面的基本概念和组成部分,并详细阐述了利用《专利法》保护图形用户界面外观设计的必要性和重要性。第二章主要介绍了美国、欧盟、日本等国对图形用户界面外观设计进行保护的立法缘由和突出特点。目前,美、欧、日等国都已对图形用户界面提供了全面而详细的保护机制。采取判例法的美国,通过若干关键案例,推动了对图形用户而界面及部分外观设计的发展。欧盟则明确将图形外观界面列为可受保护的客体。日本对图形用户界面采取严格的条件设置,保护范围较窄。同时文章还对美、欧、日在申请要件、权利效力及保护范围上的区别进行了详细列举。第三章主要围绕图形用户界面在我国正式实行外观设计专利保护展开。2014年《专利审查指南》主要从三个方面就如何保护图形用户界面作了规定,相比美、欧、日的判断基准,我国既没有日本那样严格,也不想美国、欧盟那样宽松,总体保持相对中间的态度。其次,文章列举了三种较为普遍的图形用户界面申请实例。最后提出了对图形用户界面进行外观设计保护的建议,一是开放部分设计完善外观设计保护制度,二是放宽产品名称限制扩大图形用户界面的保护范围。
[Abstract]:With the improvement of science and technology, in addition to excellent performance and shape, graphical user interface has become an important factor for consumers to choose and purchase modern electronic products. The 2014 revised Patent Review Guide has formally included graphical user interfaces in design patent protection. The full text is divided into three chapters. The first chapter mainly introduces the graphical user interface. This paper briefly introduces the basic concepts and components of the graphical user interface, and expounds in detail the necessity and importance of using patent law to protect the appearance design of the graphical user interface. The second chapter mainly introduces the legislative reasons and prominent features of the graphical user interface design protection in the United States, European Union, Japan and other countries. At present, the United States, Europe, Japan and other countries have provided a comprehensive and detailed protection mechanism for graphical user interfaces. The case law of the United States, through a number of key cases, to promote the graphical user interface and part of the design development. The EU explicitly lists graphical interfaces as protected objects. Japan to the graphical user interface to take strict conditions set, the scope of protection is narrower. At the same time, the differences in the application requirements, the validity of rights and the scope of protection of the United States, Europe and Japan are listed in detail. The third chapter mainly focuses on the formal implementation of patent protection for design in China. The Patent Review Guide of 2014 mainly stipulates how to protect the graphical user interface from three aspects, compared with the judging benchmarks of the United States, Europe and Japan. Our country is neither as strict as Japan, nor as loose as the United States and the European Union. Secondly, this paper enumerates three universal application examples of graphical user interface (GUI). Finally, some suggestions are put forward to protect the graphical user interface. One is to open the design to perfect the design protection system, the other is to relax the product name limit and expand the protection scope of the graphical user interface.
