街区制推行中的权利冲突与解决路径探究

【摘要】:为了解决发展过程中凸现出的各类"城市病",通过从规划上逐步推行街区制,开放封闭小区、打开单位大门等方式促进城市内部资源在不同主体间达成共享,并对小区内的公共绿地、道路等进行整合,以满足城市发展和市民民生的需要。在此过程中,业主的居住权会与城市发展权、市民民生权产生冲突。对于这些权利之间的冲突关系,现有法律体系中并没有提供行之有效的解决方案。因此,可以在借鉴域外有关规则的基础上,引入公共地役权制度,通过协商的方式,在不改变财产权属的前提下,协调城市发展、市民民生与业主现有居住权之间的冲突。
[Abstract]:In order to solve all kinds of "urban diseases" that appear in the course of development, by gradually carrying out block system in planning, opening closed district, opening the gate of the unit and so on, the internal resources of the city can be shared among different subjects. In order to meet the needs of urban development and people's livelihood, the paper integrates the public green space and roads in the district. In this process, the owner's right of residence will conflict with the right of urban development and the right of people's livelihood. The existing legal system does not provide an effective solution to the conflict between these rights. Therefore, we can introduce the public easement system on the basis of drawing lessons from the relevant rules of foreign countries, and coordinate the conflict between urban development, people's livelihood and owners' existing residence rights by means of negotiation and without changing the ownership of property rights.
