【摘要】：本文以马克思主义基本原理作为指导,以农民工作为研究对象,以农民工权益的法律保障为主线,以构建和完善社会主义和谐社会作为落脚点,深入的分析了农民工权益的法律保障的迫切性与必要性,客观阐述了农民工权益保障的重要性,从我国现有的法律制度与农民工自身方面解析了农民工权益的法律保障与和谐社会的关系。从我国的实际情况为出发点,以马克思主义基本原理为指导,理论联系实际,系统分析当前我国对农民工权益保障的发展情况。本文分为三部分：一、对农民工权益保障的理论阐述。这部分是研究本文的前提和基础,也是解析农民工权益法律保障的指导方法。本文以我国农民工权益保障的现状及农民工生存状况为背景,以马克思主义雇工权益保护理论、马克思主义人权观和我国的法治理论为指导方法,剖析我国农民工权益的法律保障与和谐社会的关系。二、本部分分析了当前我国农民工权益保障的现状及原因,主要针对当前我国农民工权益保障的现状及存在的问题。主要从农民工的经济权利、社会保障、政治权利、文化教育权利四个方面展现当前我国对农民工法律权益保护方面存在的问题,横向上针对我国对农民工法律权益保护的传统体制、社会环境、政策环境、法律制度、和农民工自身的五个因素方面分析对农民工法律权益保护的影响。三、对农民工权益保障提供相关解决措施,这部分是本文研究的核心部分,分别从立法、行政执法和构建农民工权益保障体制三大方面进行系统阐述,对农民工权益的保障提供具体针对性解决措施。本文通过对农民工权益保障的研究,依据提出问题、分析问题、解决问题的思路,以马克思主义基本原理作为指导,对我国农民工权益的保障提出了几项针对性对策,对我国农民工的合法权益在法律和制度方面给予保障,让农民工更好的参与到我国城市化与现代化的建设进程中来,有利于维护社会的长治久安,促进我国的社会主义和谐社会建设进程,确保我国全面建设小康社会的目标如期完成。
[Abstract]:This paper takes the basic principles of Marxism as the guidance, migrant workers as the research object, the legal protection of the rights and interests of migrant workers as the main line, and the construction and improvement of a harmonious socialist society as the foothold. It deeply analyzes the urgency and necessity of the legal protection of the rights and interests of migrant workers, and objectively expounds the importance of the protection of the rights and interests of migrant workers. This paper analyzes the relationship between the legal protection of the rights and interests of migrant workers and the harmonious society from the aspects of the existing legal system and migrant workers themselves. From the point of view of the actual situation of our country, guided by the basic principles of Marxism, this paper systematically analyzes the development of the protection of the rights and interests of migrant workers in our country at present under the guidance of integrating theory with practice. This article is divided into three parts: first, the protection of migrant workers rights and interests of the theoretical elaboration. This part is the premise and foundation of the study, and is also the guiding method to analyze the legal protection of the rights and interests of migrant workers. This paper takes the present situation of the protection of migrant workers' rights and interests in our country as the background, the Marxist theory of protection of the rights and interests of hired workers, the Marxist view of human rights and the theory of the rule of law in our country as the guiding method. This paper analyzes the relationship between the legal protection of the rights and interests of migrant workers and the harmonious society. Second, this part analyzes the current situation and reasons of the protection of the rights and interests of migrant workers in China, mainly in view of the current situation and problems of the protection of the rights and interests of migrant workers in China. Mainly from the four aspects of economic rights, social security, political rights, cultural and educational rights of migrant workers, it shows the problems existing in the protection of the legal rights and interests of migrant workers in our country. In view of the traditional system, the social environment, the policy environment, the legal system, and the five factors of the protection of the legal rights and interests of the migrant workers in China, this paper analyzes the influence on the protection of the legal rights and interests of the migrant workers horizontally. Third, to provide relevant solutions to the protection of the rights and interests of migrant workers, this part is the core part of this study, respectively from the legislation, administrative law enforcement and the construction of migrant workers' rights and interests protection system three major aspects of systematic elaboration. Protection of the rights and interests of migrant workers to provide specific targeted solutions. Based on the research on the protection of the rights and interests of migrant workers, this paper puts forward several targeted countermeasures for the protection of the rights and interests of migrant workers in China under the guidance of the basic principles of Marxism and the train of thought of raising, analyzing and solving the problems. The legal rights and interests of migrant workers in our country are guaranteed in terms of laws and systems, so that migrant workers can better participate in the process of urbanization and modernization in our country, which is conducive to maintaining the long-term stability of society. To promote the process of building a harmonious socialist society in China and to ensure that the goal of building a well-off society in an all-round way is completed as scheduled.
