【摘要】： 共同危险行为制度解决了“数人均有危险行为，但不知何人之行为造成损害结果”时如何归责的问题。由于“无辜的行为人”比“无辜的受害人”更具可归责性，故应对前者归责。共同危险行为的构成要件有三：主体复数性，行为人均实施了具有危险性的行为，损害结果系一人或数人所致、但不能判定谁是加害人。共同危险行为人中的非实际致害人亦有过错，但行为人之间无意思联络，行为人的过错可以有多种组合方式。构成共同危险行为不以行为的“共同性”为必要，行为人致人损害的危险在造成实际损害时必须已经存在，，共同危险行为的因果关系是一种拟制的因果关系。共同危险行为人对外承担连带责任，对内有权追偿，并享有两类抗辩事由。我国有必要确立此项制度，应当借鉴国外先进的立法经验并总结现有成果，在侵权行为法立法中建立此项制度。
[Abstract]:The system of common dangerous behavior solves the problem of how to impute responsibility when "several people have dangerous behavior, but who does not know who's going to cause the result of damage". Since "innocent perpetrator" is more liable than "innocent victim", the former should be held responsible. There are three elements of common dangerous behavior: the subject is plural, and the behavior is dangerous. Damage is caused by one or more persons, but it is not possible to determine who is the perpetrator. The non-actual perpetrator of the joint dangerous actor is also at fault, but there is no meaningful liaison between the perpetrators, The actor's fault can be combined in a variety of ways. The "commonality" of the act is not necessary to constitute a common dangerous act, and the danger of injury caused by the perpetrator must already exist when the actual harm is caused, The causality of common dangerous behavior is a kind of fictitious causality. The joint dangerous doer shall bear joint and several liability and shall have the right to recover the liability and enjoy two kinds of defenses. It is necessary to establish this system in our country. We should learn from the advanced legislative experience of foreign countries and sum up the existing achievements. This system is established in the law of tort.
