我国地下空间开发法制体系的反思与完善

【摘要】：我国目前地下空间开发法制体系存在法律位阶过低、偏重行政管理、内容模糊缺少可操作性等缺陷。和地表开发相比,地下空间开发具有不可逆性、整体性、投资效益差、公益设施优先、结建式开发较多、主要集中于大城市及其中心城区等特点。全国人大常委会应当独立制定一部完整的"地下空间开发法",同时配套制定单行法规、规章,以此构建我国的地下空间开发法制体系。我国地下空间开发法制体系应当包括地下空间资源调查和评估制度、地下空间土地使用权管理制度、地下空间建设管理制度、地下空间开发建设促进制度等等。我国还应当着力强化地下空间开发规划法制体系的建设,加强规划强度、细化规划内容、创新规划实施方式。
[Abstract]:At present, the legal system of underground space development in our country has some defects, such as too low legal rank, emphasis on administration, vague content and lack of maneuverability. Compared with the surface development, the underground space development has the characteristics of irreversibility, integrity, poor investment benefit, priority of public welfare facilities, more built-up development, and mainly concentrated in big cities and their central urban areas. The standing Committee of the National people's Congress should independently formulate a complete Law on the Development of Underground Space, and at the same time, formulate separate laws and regulations to construct the legal system for the development of underground space in China. The legal system of underground space development in China should include the investigation and evaluation system of underground space resources, the management system of the right to use the land in underground space, the management system of underground space construction, the system of promoting the development and construction of underground space, and so on. Our country should also strengthen the construction of the legal system of underground space development and planning, strengthen the intensity of the planning, refine the contents of the planning, and innovate the mode of implementation of the planning.
