独立担保的单据机制研究

【摘要】：除了独立抽象性之外,单据性是独立担保的另一重要特征。根据付款条件的差异,独立担保项下的单据可分为付款请求书、违约声明、第三方文件、法院判决或仲裁裁决等类型。在各国法律上,独立担保领域普遍遵循单据严格相符的原则,要求单据与付款条件、单据与单据之间表面相符。由于独立担保项下的单据缺乏标准化,各国司法实践中严格相符原则的尺度宽严不一。我国法院应当在严格相符原则的基础上,坚持单据的种类、类型和内容上的严格标准,以维护独立担保的确定性和效率性。
[Abstract]:In addition to independent abstraction, documentary nature is another important feature of independent guarantee. According to the difference of payment terms, documents under independent guarantee can be classified into payment request, declaration of default, third party documents, court decision or arbitration award. In the national law, the independent guarantee field generally follows the principle of strict conformity of documents, requiring documents and payment conditions, documents and documents between the surface consistency. Due to the lack of standardization of documents under independent guarantee, the standards of strict conformity in judicial practice vary widely. On the basis of the principle of strict conformity, the courts of our country should insist on the strict standards of the types, types and contents of documents in order to maintain the certainty and efficiency of the independent guarantee.
