大明王朝的“四张面孔”:新媒体环境中著作权各方的权利与义务——以《大明王朝的七张面孔》相关方的新媒体论战为例

【摘要】：2016年年初,《大明王朝的七张面孔》的作者张宏杰在互联网专栏写作服务平台"腾讯大家"上发表了基于该作品著作权纠纷的批评性长文,将著作侵权矛头指向责任编辑吴怀尧、出版方果麦文化及其董事长路金波,引发各方在微博平台上的交锋论战。文章根据四方公开发布的信息,结合《中华人民共和国著作权法》相关条文展开分析,认为在当前的新媒体环境中,出版产业链各方在出现著作权纠纷事件时,更愿意通过自媒体或社交媒体平台来争取舆论支持,由于表述和立场等方面的分歧,很容易出现著作权保护上各方权利和责任不对等的问题。
[Abstract]:In early 2016, Zhang Hongjie, author of Seven faces of the Daming Dynasty, published a long critical article based on the copyright dispute in Tencent, an Internet column-writing service, pointing the finger at responsible editor Wu Huaiyao. The publication of the square fruit culture and its chairman, Lu Jin Bo, triggered a debate on the Weibo platform. Based on the information released by the Quartet and the relevant articles of the copyright Law of the people's Republic of China, the article analyzes that in the current new media environment, the parties in the publishing industry chain are involved in copyright disputes. It is more willing to win public opinion support through self-media or social media platform, because of the differences in expression and position, it is easy to appear the problem of unequal rights and responsibilities of all parties in copyright protection.
