孤儿作品内涵双重推定法律问题研究

【摘要】：在媒介融合、云计算技术之下,孤儿作品的"孤儿"、"使用"、"使用者"等概念需要结合外国立法细致分析。对于孤儿作品与公有领域,主张采用孤儿作品未落入公有领域的立法推定,即除非使用者能够提供明确证据证明已发表孤儿作品的发表时间,或者未发表孤儿作品的完成时间,则应推定孤儿作品尚未落入公有领域,避免立法规定孤儿作品与公有领域相互排斥观点的逻辑矛盾之虞。关于孤儿作品是否应当包括未发表作品问题,从扩展知识可及性角度,除非有作者不同意发表等相反证据,孤儿作品应当包括未发表的作品。
[Abstract]:Under the technology of media convergence and cloud computing, the concepts of "orphan" and "user" need to be analyzed in combination with foreign legislation. With regard to orphans' works and the public domain, the legislative presumption that orphans' works are not in the public domain is advocated, that is, unless the user can provide clear evidence of the time of publication of an orphan's work, or the time of completion of an unpublished orphan's work, It should be presumed that the orphan works have not fallen into the public domain and avoid the logical contradiction between the legislation and the views of mutual exclusion between the orphan works and the public domain. As to whether an orphan's work should include an unpublished work, the orphan's work should include an unpublished work from the point of view of expanding intellectual accessibility, unless there is contrary evidence that the author does not agree to publication.
